Subject: Authorize Mutual Aid Agreement - Public Integrity Task Force
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute a Mutual Aid Agreement, in substantially the attached form,
between the member agencies of the Southeast Florida Public Integrity Task Force
Voluntary Cooperation, and the Florida Department of Law Enforcement ("FDLE"), until
December 31, 2019, to receive and extend mutual aid in the form of law enforcement
services and resources to combat public corruption activity, official misconduct, and
related criminal violations and to disrupt persons and organizations engaged in such
activity, as defined in Part 1, Chapter 23, Florida Statutes.
Background of Item:
The subscribed law enforcement agencies have joined together in a multi -jurisdictional
effort to target individuals that are believed to be violating state and federal laws related
to public corruption, official misconduct, and other related crimes. These agencies are
all participants in a multi -agency effort known collectively as the Public Integrity Task
Force. They agree to utilize applicable state and federal laws to prosecute criminal,
civil, and forfeiture actions against identified violators, as appropriate. These agencies
have the authority under Part 1, Chapter 23, Florida Statutes, the "Florida Mutual Aid
Act," to enter into a voluntary agreement for cooperation and assistance of a routine law
enforcement nature that crosses jurisdictional lines.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE THE SOUTHEAST FLORIDA
PUBLIC INTEGRITY TASK FORCE VOLUNTARY COOPERATION MUTUAL AID
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE FLORIDA
DEPARTMENT OF LAW ENFORCEMENT AND OTHER PARTICIPATING AGENCIES
TO RECEIVE AND EXTEND MUTUAL AID, PURSUANT TO THE FLORIDA MUTUAL
AID ACT, SECTION 23.12-23.127, FLORIDA STATUTES, IN THE FORM OF LAW
ENFORCEMENT SERVICES AND RESOURCES TO COMBAT PUBLIC
CORRUPTION ACTIVITY, OFFICIAL MISCONDUCT, RELATED CRIMINAL
VIOLATIONS, AND TO DETER PERSONS AND ORGANIZATIONS ENGAGED IN
SUCH ACTIVITY.
WHEREAS, the Florida Department of Law Enforcement ("FDLE") and the City of Miami
("City") have authority under the Florida Mutual Aid Act, Section 23.12, et seq., Florida Statutes,
to enter into this Southeast Florida Public Integrity Task Force Voluntary Cooperation Mutual
Aid Agreement ("Agreement"); and
WHEREAS, federal, state, and local law enforcement agencies have joined together to
form the Southeast Florida Public Integrity Task Force, a multi -jurisdictional effort that conducts
investigations against individuals and organizations engaged in violating state and federal laws
related to public corruption, official misconduct, and other related crimes; and
WHEREAS, the FDLE and each agency member to this Agreement work in a
collaborative effort to provide resources, equipment, and personnel upon request by any law
enforcement agency within the state to prosecute criminal, civil, and forfeiture actions against
identified violators, as appropriate; and
WHEREAS, pursuant to Section 23.127, Florida Statutes, employees of agencies that
are parties to this Agreement shall, when engaging in authorized mutual cooperation and
assistance pursuant to this Agreement, have the same powers, duties, rights, privileges, and
immunities as if the employees were performing duties inside the law enforcement jurisdictional
area of their respective agencies;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized1 to execute the Agreement, in
substantially the attached form, with FDLE and member agencies to receive and extend mutual
aid in the form of law enforcement services and resources to combat public corruption activity,
official misconduct, and related criminal violations and to deter persons and organizations
engaged in such activity, as defined in Part 1, Chapter 23, Florida Statutes.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
