A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED
PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S FINDING, ATTACHED AND INCORPORATED AS ATTACHMENT
"A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES
ARE NOT PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI
("CITY"), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID
PROCEDURES; AUTHORIZING THE ALLOCATION OF FUNDS IN THE
AMOUNT OF $25,000.00 TO FANN AYISYEN NAN MIYAMI/HAITIAN WOMAN
OF MIAMI, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("FANN
AYISYEN NAN MIYAMI"), FOR PUBLIC SERVICES ACTIVITIES; ALLOCATING
FUNDS FROM THE SOCIAL SERVICES GAP PROGRAM FUND, ACCOUNT
NO. 00001.910101.882000; AUTHORIZING THE CITY MANAGER TO
EXECUTE ANY AND ALL AGREEMENT(S), IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, WITH FANN AYISYEN NAN MIYA, FOR SAID
PURPOSE.
WHEREAS, due to the continuous decrease of available Community Development Block
Grant ("CDBG") funds in the last few years, Public Services agencies' allocations have been
reduced resulting in reduction of services to City of Miami ("City") residents; and
WHEREAS, the City Commission wishes to allocate funding to cover public service
program shortfalls for fiscal year 2017-2018 from the Social Services Gap Program ("SSG")
fund, account No. 00001.910101.882000; and
WHEREAS, on September 28, 2017, the City Commission approved a contribution from
General Funds that included an amount of $743,000.00 for Public Services activities; and
WHEREAS, Fann Ayisyen Nan Miyami/Haitian Woman of Miami, Inc., a Florida not for
profit corporation ("Fann Ayisyen Nan Miyami"), has served the community for many years and
provides after school programs to low and moderate income families ("Program"); and
WHEREAS, the City Manager has made a written finding, attached and incorporated as
Attachment "A," that pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as
amended ("City Code"), competitive negotiation methods and procedures are not practicable or
advantageous to the City for obtaining said services and has recommended to the City
Commission that the finding, attached and incorporated as Attachment "A," be adopted and that
competitive bidding methods and procedures be waived for the Program; and
WHEREAS, the City Administration recommends the allocation of funds in the amount of
$25,000.00 from SSG to Fann Ayisyen Nan Miyami for the Program;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the
City Manager's finding, attached and incorporated as Attachment "A," that competitive
negotiation methods and procedures are not practicable or advantageous to the City pursuant to
Section 18-85(a) of the City Code, and waiving the requirements for said procedures, is ratified,
approved, and confirmed.
Section 3. The City Manager is authorized' to allocate grant funds in an amount not to
exceed $25,000.00 to Fann Ayisyen Nan Miyami for Public Services activities, with said funds
allocated from Social Services Gap Program, Account No. 00001.910101.882000.
Section 4. The City Manager is authorized' to execute any and all agreement(s), in a
form acceptable to the City Attorney, with Fann Ayisyen Nan Miyami, for the Program.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
