A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE
AGREEMENT ("LICENSE"), IN SUBSTANTIALLY THE ATTACHED FORM,
BETWEEN THE CITY OF MIAMI ("CITY") AND 1010 NW LLC. FOR THE CITY'S
USE OF APPROXIMATELY 206,530 SQUARE FEET OF LAND LOCATED AT
1010 NORTHWEST 72ND AVENUE, MIAMI, FLORIDA, FOR THE STAGING OF
HURRICANE IRMA DEBRIS REMOVAL AND DISPOSAL, IN THE AMOUNT OF
TWENTY THREE THOUSAND EIGHT HUNDRED DOLLARS ($23,800.00) PER
MONTH, UNTIL THE SITE IS NO LONGER NEEDED FOR SUCH PURPOSES;
FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE SUCH OTHER FUTURE AGREEMENTS, IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, WITH ADDITIONAL PROPERTY OWNERS, BOTH
PRIVATE AND PUBLIC, AS DEEMED NECESSARY, TO CLEAR SAID
REMAINING DEBRIS FROM THE CITY; ALLOCATING FUNDS FROM
ACCOUNTS TO BE IDENTIFIED BY THE CITY MANAGER, SUBJECT TO
BUDGETARY APPROVAL AT THE TIME OF NEED.
WHEREAS, it is necessary to take rapid measures to eliminate immediate threats to the
life, health, and safety of residents and employees; eliminate immediate threats to undamaged
property; and ensure economic recovery to the City of Miami ("City") and the community
associated with Hurricane Irma; and
WHEREAS, the City has contracted with vendors for the removal and disposal of debris
from City streets; and
WHEREAS, the City -owned properties earmarked to store the debris before the debris is
processed and sent to a landfill, or similar sites, are nearly at capacity; and
WHEREAS, the City has begun reaching out to private land owners in an effort to locate
properties for short term storage of the remaining debris; and
WHEREAS, 1010 NW LLC. and the City have come to an agreement on the terms for a
Revocable License Agreement ("License") which is revocable by either party upon providing
fifteen (15) days written notice; and
WHEREAS, the City Manager is seeking authority to execute the License with 1010 NW
LLC.; and
WHEREAS, the City will require additional sites beyond this property to accomplish the
goal of removing the remaining debris from the right-of-ways within the City; and

WHEREAS, the City Manager is requesting authority to enter into any additional
agreements, in a form acceptable to the City Attorney, for amounts determined to be fair market
value by a comparative market analysis, without the need for further Commission approval;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute a License, in substantially the
attached form, between the City and 1010 NW LLC. for the City's use of approximately 206,530
square feet of land located at 1010 Northwest 72nd Avenue, Miami, Florida, for the staging of
Hurricane Irma debris removal and disposal, in the amount of $23,800.00 per month, until the
site is no longer needed for such purposes.
Section 3. The City Manager is further authorized to negotiate and execute such other
future agreements, in a form acceptable to the City Attorney, with additional property owners,
both private and public, as deemed necessary, to clear said remaining debris from the City.
Section 4. Funds are to be allocated from accounts to be identified by the City Manager,
subject to budgetary approval at the time of need.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
