Background of Item: It is necessary to take rapid measures to eliminate immediate threats to the life, health, and safety of residents and employees; eliminate immediate threats to undamaged property; and ensure economic recovery to the City of Miami ("City") and the community. The City has contracted with vendors to execute the removal of debris from City streets as a result of Hurricane Irma. The City owned properties earmarked to store the debris before it is processed and sent to a landfill or similar sites are nearly at capacity. The City has begun reaching out to private land owners in an effort to license their property for a short term in an effort to store the remaining debris. 1010 NW LLC and the City have come to an agreement on the terms of a License which is revocable by either party upon providing 15 days written notice. The City will require additional sites beyond this one to accomplish the goal of removing all debris from the right of way's. The City Manager is seeking authority to enter into additional agreements for amounts determined to be fair market value by a comparative market analysis without the need for commission approval. FOR THE CITY'S USE OF APPROXIMATELY 206,530 SQUARE FEET OF LAND LOCATED AT 1010 NORTHWEST 72ND AVENUE, MIAMI, FLORIDA, FOR THE STAGING OF HURRICANE IRMA DEBRIS REMOVAL AND DISPOSAL, IN THE AMOUNT OF TWENTY THREE THOUSAND EIGHT HUNDRED DOLLARS ($23,800.00) PER MONTH, UNTIL THE SITE IS NO LONGER NEEDED FOR SUCH PURPOSES; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE SUCH OTHER FUTURE AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH ADDITIONAL PROPERTY OWNERS, BOTH PRIVATE AND PUBLIC, AS DEEMED NECESSARY, TO CLEAR SAID REMAINING DEBRIS FROM THE CITY; ALLOCATING FUNDS FROM ACCOUNTS TO BE IDENTIFIED BY THE CITY MANAGER, SUBJECT TO BUDGETARY APPROVAL AT THE TIME OF NEED. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute a License, in substantially the attached form, between the City and 1010 NW LLC. for the City's use of approximately 206,530 square feet of land located at 1010 Northwest 72nd Avenue, Miami, Florida, for the staging of Hurricane Irma debris removal and disposal, in the amount of $23,800.00 per month, until the site is no longer needed for such purposes. Section 3. The City Manager is further authorized' to negotiate and execute such other future agreements, in a form acceptable to the City Attorney, with additional property owners, both private and public, as deemed necessary, to clear said remaining debris from the City. Section 4. Funds are to be allocated from accounts to be identified by the City Manager, subject to budgetary approval at the time of need. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: nd City Att©r ey 10/17/2017 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
