Subject: Authorize MOU - City Debris Removal
Purpose of Item:
A resolution of the Miami City Commission authorizing the City Manager to enter into a
memorandum of understanding ("MOU") with Miami -Dade County, Florida for removal
of debris from county maintained right-of-ways due to Hurricane Irma, pursuant to
section 18-90 of the Code of the City of Miami, Florida as amended.
Background of Item:
On September 4, 2017, Florida Governor Rick Scott issued Executive Order Number
17-235 declaring a State of Emergency for all counties in Florida including Miami -Dade
County ("County") because of the severe threat posed by Hurricane Irma. On
September 5, 2017, County Mayor Carlos A. Gimenez declared a Local State of
Emergency for the County because of the threat posed by Hurricane Irma; and on
September 8, 2017, the City of Miami ("City") Mayor Tomas Regalado declared a Local
State of Emergency for the City because of the threat posed by Hurricane Irma. The
County and the City are each engaged in disaster recovery and debris removal services
to clear public roadways from debris caused by Hurricane Irma. Prompt debris removal,
while essential to restoring roadways and public rights -of -way to effective operation,
restore power, and to deliver essential services, must be performed in compliance with
all applicable Federal Emergency Management Agency ("FEMA") or other applicable
regulations to insure reimbursement.
The County and the City find it in their best interest to have a Memorandum of
Understanding ("MOU") regarding debris clearance operations on County -owned roads
and Right -of -Ways within the City.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A
FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, RETROACTIVELY AUTHORIZING
THE CITY MANAGER TO ENTER INTO A MEMORANDUM OF UNDERSTANDING, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH MIAMI-DADE COUNTY, FLORIDA,
FOR REMOVAL OF DEBRIS FROM COUNTY MAINTAINED RIGHT-OF-WAYS DUE
TO HURRICANE IRMA, PURSUANT TO SECTION 18-90 OF THE CODE OF THE
CITY OF MIAMI, FLORIDA, AS AMENDED, AND RETROACTIVELY AUTHORIZING
THE EXPENDITURE OF FUNDS FOR SAID PURPOSE; ALLOCATING SAID FUNDS
FROM EMERGENCY FUND 80000.
WHEREAS, on September 4, 2017, Florida Governor Rick Scott issued Executive Order

WHEREAS, on September 5, 2017, County Mayor Carlos A. Gimenez declared a Local
State of Emergency for the County because of the threat posed by Hurricane Irma; and
WHEREAS, on September 8, 2017, the City of Miami ("City") Mayor Tomas Regalado
declared a Local State of Emergency for the City because of the threat posed by Hurricane
Irma; and
WHEREAS, the County and the City are each currently engaged in disaster recovery
and debris removal services to clear public roadways from debris caused by Hurricane Irma;
and
WHEREAS, prompt debris removal, while essential to restoring roadways and public
Right -of -Ways to effective operation, restore power, and to deliver essential services, must be
performed in compliance with all applicable Federal Emergency Management Agency ("FEMA")
or other applicable regulations to insure reimbursement; and
WHEREAS, the County and the City find that, due to an exigent circumstance, it is in the
best interest of the health, safety and welfare of their residents to have a Memorandum of
Understanding ("MOU") regarding debris clearance operations on County -owned roads and
Right -of -Ways within the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, the City Manager is retroactively
authorized' to enter into a MOU, in substantially the attached form, with the County, for removal
of debris from county maintained Right -of -Ways areas due to Hurricane Irma, pursuant to
Section 18-90 of the Code of the City of Miami, Florida, as amended, and retroactively
authorizing the expenditure of funds for said purpose.
Section 3. The City Manager is authorized' to allocate funds from Emergency fund 80000.
Section 4. The City Clerk is directed to transmit a certified copy of this Resolution to the
County Mayor Carlos A. Gimenez and the Miami -Dade County Board of County
Commissioners.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
