A. REQUEST
Pursuant to Policy LU-1.6.4 of the Miami Comprehensive Neighborhood Plan (MCNP), the
request is to repeal Ordinance 13473 (Exhibit "B"), adopted on June 24, 2014, which
amended Ordinance No. 10544, the Future Land Use Map (FLUM) of the MCNP by
changing the FLUM designation of the property at 104 NW 1 Avenue from "Central Business
District" within the Urban Central Business District to "Public Parks and Recreation" within
the Urban Central Business District. The request would revert the existing Future Land Use
Designation from "Public Parks and Recreation" within the Urban Central Business District
to "Central Business District" within the Urban Central Business District.
A change to the Miami 21 Zoning Atlas corresponding to this proposed change to the Future
Land Use Map is required as a companion item (File ID No. 2639). The companion
application seeks to repeal Ordinance 13474 and revert the Miami 21 Zoning designation
back to T6-80-0 (Urban Core - Open).
B. BACKGROUND:
On October 22, 2015, the Miami City Commission passed Resolution R-15-0474 which
authorized the City Manager to negotiate a Real Estate Purchase and Exchange Agreement
with affiliate corporations of All Aboard Florida for the land exchange involving the property
at 104 NW 1 Avenue, in which the City would receive nearby land to construct a new fire
station to service the area. Additionally, the property is located within the Downtown
Intermodal District Corridor Subzone, a Miami -Dade County Rapid Transit Zone designation
(Exhibit "C"), relating to the development of the Miami Central Station (as indicated in County
Resolution R-353-14, attached as Exhibit "D"). Rapid Transit Zone designations give the
County authority over various services that would otherwise normally be administered by
the local municipality. in this case, Miami Dade County is the responsible agency for zoning
and land use regulations and site development review.

C. ANALYSIS
Pursuant to Future Land Use Policy LU-1.6.4, staff has reviewed the impacts of the
proposed reversion of the FLUM designation.
Future Land Use and the Rapid Transit Zone
Under the Rapid Transit Zone designation, Miami Dade County has the authority to review
and approve development that works toward providing premium transit infrastructure to the
area's constituents. In this case, the subject property is within the Downtown lntermodal
District Corridor Subzone, which covers the area to be developed for the Miami Central
Station. The Miami Central Station will introduce two new premium transit facilities to
Downtown Miami: the Brightline train service to Orlando and the Tri-Rail Coastal Link.
The reversion of this property back to "Central Business District" will aid in the provision of
those much needed services to the residents of the region. The "Central Business District"
designation would allow up to 176 units, at a density of 1,000 dwelling units per acre. Given
the small area of land subject to the change, the impact from additional dwelling units is
minimal. This Future Land Use Map Amendment aligns with the intent of the designation of
the Urban Central Business District which "shall contain mass transit service...and shall
contain high intensity, high density multi -use development..." (Future Land Use Element).
Furthermore, Future Land Use Objective LU-1.4 states "Continue the growth of Downtown
Miami, expand its role as a center of domestic an international commerce, further its
development as a regional center for the performing arts and other cultural and
entertainment activities and develop an urban residential base." With the reversion back to
"Central Business District", this property will better serve Downtown Miami as a part of the
development of a transit and mixed -use development of State and Regional importance.

Parks Level of Service
MCNP Policy PR-2.1 requires that "conversion of park land for any other purposes be
subject to public procedures, and replace the converted park land with Land similar in park,
recreation, or conservation value in terms of usefulness and location." Analyzed in terms of
acreage, the exchange of land with All Aboard Florida will decrease parks and recreation
space in Downtown Miami by 7,677 square feet. However, in terms of usefulness, the space
is not used by Downtown residents and visitors, as it is not situated in a comfortable
environment.
The property is small and surrounded by heavily trafficked downtown streets, creating an
"island" effect. Within the 10 minute walk service area of this block, there are many more
comfortable parks for downtown residents, including Bayfront Park, Museum Park, Paul
Walker Mini Park, and the park adjacent to the Steven P. Clark Government Center. In
addition, there are a number of high -quality civic spaces, such as the plaza adjacent to the
Wilkie D. Ferguson Jr. Federal Courthouse. Furthermore, the City is designating
approximately 16,000 square feet of land to Public Parks and Recreation adjacent to Eaton
Park in the City's Upper Eastside, putting the City ahead in terms of total publically
designated park space.

D. RECOMMENDATION:
Based on the above background information, the Planning & Zoning Department
recommends approval of the request to repeal Ordinance 13473, adopted on June 24, 2014
and revert the FLUM designation back to "Central Business District" within the Urban Central
Business District for the site located at 104 NW 1 Avenue.

AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AMENDING ORDINANCE NO. 10544, AS AMENDED, THE FUTURE LAND USE
MAP OF THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN, PURSUANT TO
SMALL SCALE AMENDMENT PROCEDURES SUBJECT TO §163:3187, FLORIDA
STATUTES, BY CHANGING THE FUTURE LAND USE DESIGNATION OF THE
ACREAGE DESCRIBED HEREIN OF REAL PROPERTY AT APPROXIMATELY 104
NORTHWEST 1ST AVENUE, MIAMI, FLORIDA, FROM "CENTRAL BUSINESS
DISTRICT" WITHIN THE "URBAN CENTRAL BUSINESS DISTRICT" TO "PUBLIC
PARKS AND RECREATION" WITHIN THE "URBAN CENTRAL BUSINESS
DISTRICT'; MAKING FINDINGS; DIRECTING TRANSMITTALS TO AFFECTED
AGENCIES; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS —the Miami Planning; Zoning -and -Appeals -Board; atits-meeting-on-Ma-y 21, 2014,
following an advertised public hearing, adopted Resolution No. PZAB-R-14-042 by a vote of ten to
zero (10-0), item no. 7, recommending APPROVAL of the. Future Land Use Change as set forth; and
WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable
and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this
change of land use designation as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. Ordinance No. 10544, as amended, the Future Land Use Map of the Miami
Comprehensive Neighborhood Plan, pursuant to small scale amendment procedures subject to
§163.3187, Florida Statutes, is further amended by changing the Future Land Use designation of
0.176± acres of real property(ies) at approximately 104 NW 1st Avenue, Miami, Florida, from "Central
Business District" within the "Urban Central Business District" to "Public Parks and Recreation" within
the "Urban Central Business District"; as depicted in "Exhibit A", attached and incorporated.
Section 3. It is found that this Comprehensive Plan designation change involves a use of 10
acres or fewer and:
(a) Is necessary due to changed or changing conditions;
(b) The cumulative annual effect of the acreage for all small scale development
amendments adopted by the local government does not exceed a maximum of 120 acres in a calendar

year;
(c) The proposed amendment does not involve a text change to goals, policies, and
objectives of the local government's comprehensive plan, but proposes a land use change to the
future land use map for a site -specific development. However, text changes that relate directly to, and
are adopted simultaneously with the small scale Future Land Use Map amendment shall be
permissible;
(d) Is one which is not located within an area of critical state concern as designated by
§380.0552, Florida Statutes or by the Administration Commission pursuant to §380.05(1), Florida
Statutes;
(e) Density will be "Public Parks and Recreation", 0 dwelling units per acre, per the Miami
Neighborhood Comprehensive Plan, as amended, and intensity will be as established in Article 4 of the
City of Miami Zoning Ordinance, the Miami 21 Code, as amended; and
(f) The proposed amendment complies with the applicable acreage and density limitations
set forth in the Local Government Comprehensive Planning and Land Development Regulation Act
including, without limitation, §163.3187, Florida Statutes.
Section 4. The City Manager is directed to instruct the Director of the Planning and Zoning
Department to promptly transmit a certified copy of this Ordinance after its adoption on second reading
to: the reviewing agencies pursuant to §163.3184, Florida Statutes; and any other person or entity
requesting a copy.
Section 5. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance may not become effective until thirty-one (31) days after second reading
and adoption thereof pursuant and subject to §163.3187, Florida Statutes. {1}
