WHEREAS, the Wynwood Yard located approximately at 56, 64, 70, 82 Northwest 29th Street, Miami, Florida ("Yard") has been operating for the past two (2) years pursuant to Section 62-535 of the Code of the City of Miami, Florida, as amended ("City Code"), entitled "Temporary uses on vacant land" ("TUP"); and WHEREAS, the TUP expires on October 20, 2017 and the City Commission has legislation set within thirty (30) days to address the allowable time span for the continued operation of Yard in its present capacity; and WHEREAS, allowing Yard to continue to operate is in the best interests of the City of Miami's residents and local businesses; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Yard's current TUP extended for an additional thirty (30) days from the date of the expiration of October 20, 2017 to allow the Yard to continue to operate in the same scope and manner in which it currently operates while legislation regarding the TUP timeframes is considered by the City Commission. Section 3. This Resolution shall become effectively immediately upon its adoption and signature of the Mayor. 1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. APPROVED AS TO FORM AND CORRECTNESS:
