HomeMy WebLinkAboutResolutionCity of Miami Resolution Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 1139 TO BE WITHDRAWN SPONSOR(S): Commissioner Francis Suarez Final Action Date: 10/12/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO CREATE, WITHIN CURRENT BUDGETARY CONSIDERATIONS, AN OFFICE OF TRANSPARENCY, UNDER THE PURVIEW OF THE CITY MANAGER, WITH THE RESPONSIBILITY OF MANAGING PUBLIC RECORDS REQUESTS IN AN OPEN AND TRANSPARENT MANNER, INCLUDING MAKING PUBLIC RECORDS REQUESTS AND THE RESPONSES AVAILABLE ONLINE FOR THE PUBLIC TO ACCESS AND DOWNLOAD; FURTHER DIRECTING THE CITY MANAGER TO PLACE INFORMATION ON THE MAIN PAGE OF THE OF THE CITY OF MIAMI'S ("CITY") WEBSITE ON HOW TO SUBMIT A PUBLIC RECORDS REQUEST TO THE CITY; FURTHER DIRECTING THE CITY MANAGER TO DEVELOP OR PROCURE AN ELECTRONIC MEANS OR PLATFORM THAT PUBLISHES DECISIONS RENDERED BY THE CITY COMMISSION, THE PLANNING ZONING AND APPEALS BOARD ("PZAB"), THE HISTORIC AND ENVIRONMENTAL PRESERVATION BOARD ("HEPB"), AND WARRANTS AND WAIVERS ISSUED BY THE DEPARTMENT OF PLANNING AND ZONING ("P&Z"), INCLUDING PLACING SAID INFORMATION ON THE MAIN PAGE OF THE CITY'S WEBSITE; FURTHER DIRECTING THE CITY MANAGER TO DEVELOP OR PROCURE AN ELECTRONIC NOTIFICATION SYSTEM WHEREBY THE PUBLIC MAY SUBSCRIBE TO AND RECEIVE AUTOMATIC NOTIFICATION OF ANY DECISIONS RENDERED BY THE CITY COMMISSION, PZAB, HEPB, AND WARRANTS AND WAIVERS ISSUED BY P&Z. WHEREAS, Section 24 of the Florida Constitution and the Florida Public Records Act, Chapter 119, Florida Statutes, confers on the public the right to inspect and copy any records made or received by the City of Miami ("City") and its agencies in the course of official City business; and WHEREAS, the City, its employees, and its agencies must be dedicated to fostering an open and transparent process for the public to request, inspect, and copy non-exempt public records within a reasonable period of time; and WHEREAS, the City Administration established guidelines in Administrative Policy Manual 4-11 setting forth consistent policies and procedures to safeguard the integrity of public records and to provide the public access to non-exempt public records; and WHEREAS, it is the will of the City Commission to ensure that the City and its agencies have a simplified process to allow the public to access and request public records that are created, received, or maintained by the City and its agencies in the transaction of official City business; and WHEREAS, it is also the will of the City Commission to proactively publish and make City records available to the public; and City of Miami Page 1 of 2 File ID: 1139 (Revision: A) Printed On: 1/28/2025 File ID: 1139 Enactment Number: WHEREAS, it is also the will of the City Commission and the City Administration to categorize the City's records so that they are more readily available for inspection and copying by the public; and WHEREAS, the creation of an Office of Transparency for the purpose of managing public records requests in an open and transparent manner may avoid public records lawsuits and result in potential cost savings to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is directed to create, within current budgetary considerations, an Office of Transparency, under the purview of the City Manager, with the responsibility of managing public records requests in an open and transparent manner, including making the public records requests and the responses available online for the public to access and download. Section 3. The City Manager is further directed to place information on the main page of the City's website on how to submit a public records request to the City. Section 4. The City Manager is also directed to develop or procure an electronic means or platform that publishes decisions rendered by the City Commission, the Planning, Zoning and Appeals Board ("PZAB"), the Historic and Environmental Preservation Board ("HEPB"), and warrants and waivers issued by the Department of Planning and Zoning ("P&Z"), including placing said information on the main page of the City's website. Section 5. The City Manager is further directed to develop or procure an electronic notification system whereby the public may subscribe to and receive automatic notification of any decisions rendered by the City Commission, PZAB, HEPB, and warrants and waivers issued by P&Z. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' APPROVED AS TO FORM AND CORRECTNESS: Barnaby I_.
