Said servitude has since been terminated and released. Lots 11 and 12 of Block L of the Subdivision were previously improved by a single-family home and related improvements. Said home was demolished by the prior owner per Waiver No. 2015-0147, approved on November 30, 2015, which submittal included a tree resource evaluation prepared by a certified arborist in accordance with the requirements of Sec. 3.3 of Appendix A of Miami 21. Consistent with the requirements of Sec. 3.6.g.1, Appendix A and Sec. 7.1.2.4, the Applicant submits this Warrant application to seek the approval of the reduction of a building site — Lots 11 and I2 — in existence prior to September 24, 2005. The requested Warrant is consistent with both the purpose and intent of the Coconut Grove Neighborhood Conservation District (NCD-3) and the criteria set forth in Article 4, Table 12 of Miami 21 for the following reasons: • Sec. 3.2 — Properties shall not be platted, re -platted or configured in a way that destroys a median, green space, or landscape easement or road configuration that contributes to the character of the subdivision within the NCD-3 area. The subject Warrant application would result in the construction of three (3) single-family residences on the original platted lots. No modification to the lots approved per the recorded Subdivision plan is proposed. The reduction of the existing building site comprised of Lots 11 and 12 is both consistent with the original Subdivision plan and the existing character of MIAMI • KW LAUDERDALE • TAMP,A • TALLAHASSEE January 3, 2017 Page 2 assemblages within the Subdivision today. Presently, more the 50% of the single-family residences within the Subdivision are constructed on parcels that are consistent with the dimensions of the originally platted lots within the Subdivision, which original lots consisted of lots of a standard size of 7,000 square feet. An illustration evidencing the existing development pattern described above is attached hereto as Exhibit "A." Sec. 3.6.a — Adjacent lots or tots in the same subdivision under single ownership, or developed by a single builder or developer shall not employ the same, similar or duplicate architectural plans. Adjacent buildings under such conditions shall be substantially differentiated in massing, footprint, and exterior detailing. Per the requirements of Sec. 3.6.a., the plans prepared at the direction of the Applicant for the Parcels by William Hamilton Arthur Architects, Inc. and submitted in support of the subject Warrant application, consist of three (3) uniquely designed homes that have given special consideration to the existing median(s), green space(s), landscape, tree disposition and road configuration that define the character of the Subdivision. The final design of each of the homes is built by removing only trees that were determined in the arborist's report to be substantially damaged, ill or that a posed substantial risk to public safety. The unique massing and design elements of each home are briefly outlined below: > 3501 Avocado Avenue (Lot 12): The final design of this home employs two mas The first massing consists of a primary inhabited area comprised of three (3) bedrooms, the kitchen and living area, all of which are located on two (2) levels with primary frontage along Avocado Avenue. The second massing consists of an elevated master bedroom suspended over a carport along Loquat Avenue which is connected to the rest of the structure by an elevated glass bridge. The scale and character of the carport is intended to replicate the original character of Loquat Avenue. The bridge from the master bedroom is open on one side with fenestration and overlooks an existing Laurel oak tree. The design intent of the home was to preserve the specimen oak tree and allow the family to reside around the tree on three (3) sides. 3511 Avocado Avenue (Lot 1 1): The final design for this home employs an open terrace at the rear, and a large opening and overhang at the primary facade with faceted fenestrations at both levels, creating a 2-level open proscenium within an extensive canopy of existing Alexander, Christmas and Palmetto palms, intended to reduce the scale and disambiguate the envelope of the building, connecting the natural and built environments. The rear of this home would have a covered workshop or play area that can be used for various activities by the future owner. The scale and character of the overhang is intended to replicate the original character of Loquat Avenue. 3521 Avocado Avenue (Lot 10): The final design for this home employed open terraces that rest within an extensive canopy of existing Alexander, Christmas and Palmetto palms, a large opening and overhang at the primary facade with faceted fenestrations at both levels, creating a 2-level open proscenium intended to reduce the scale and disambiguate the envelope of the building, connecting the natural and built environments. January 3, 2017 Page 3 Again, as evidenced by the accompanying plans, each home is substantially different from the other in terms of massing, footprint, and exterior detailing, although each is designed consistent with a tropical modern vernacular. Sec. 3.6.b. — All front yards in the NCD-3 shall be designed in a way that minimizes the impact of garage fronts and off-street parking. Front yards shall provide a more permeable surface and use abundant landscaping and tree canopy throughout. As evidenced by the accompanying plans, the off-street parking and parking garages or carports, to the maximum extent feasible, have been relegated to the rear or secondary front along Loquat Avenue, thus reinforcing the primary of the home itself and minimizing the impact of the garage on the front yards. The use of permeable surfaces, incorporation of abundant landscaping, and the preservation of tree canopy have been emphasized in each of the front yards for the Parcels. ■ Article 4, Table 12 —Design Review Criteria > Building Disposition — Respond to the physical context taking into consideration natural features, existing urban form and Transect Zone intentions. The proposed single-family residences seek to preserve the existing canopy and incorporate the retention of the same as a focal point of the design of each home. Further, the approval of the requested Warrant reinforces the historic and existing character of the Subdivision which consists principally of single-family home residences erected on 7,000 square foot lots with a north -south orientation. Building Function & Density— Respond to the Neighborhood context and Transect Zone. The proposed homes are consistent with the neighborhood context and conform to the requirements of Sub -Urban Transect Zone Restricted (T3-R), as modified by the NCD-3 requirements in Appendix A of Miami 21. > Parking Standards - Minimize the impact of automobile parking on the pedestrian environment and adjacent properties, especially T3 areas. As noted hereinabove, off-street parking is principally oriented to the secondary or rear Frontage along Loquat Avenue, which reinforces the character of said street and serves to minimize the impact of parking on the Principal Frontage of Avocado Avenue. > Parking Standards — For pedestrian and vehicular safety, minimize the conflicts points such as the nuanber and width of driveways and curbs. As noted hereinabove, parking has been oriented towards the secondary or rear Frontage along Loquat Avenue. As such, the primacy of Avocado Avenue has been preserved, thereby enhancing its walk -ability and character by minimizing potential points of conflict. > Landscape Standards — Preserve existing vegetation and/or geological features whenever possible. January 3, 2017 Page 4 As noted hereinabove, the proposed single-family residences preserve the existing canopy and integrate it as a focal design element for each of the proposed homes. Existing vegetation has been preserved where possible and appropriate. In light of the Warrant application's consistency with the purpose and intent of the NCD-3 regulations, its satisfaction of the pertinent design review criteria in Article 4, Table 12 of Miami 21, and the proposed development's consistency with the historic and existing character of the Subdivision, we respectfully ask for your favorable consideration and approval of this request. On September 17 1956, a single family residential structure was constructed on Lots 11 and Lot 12 (3600 Hibiscus St), located on Cocoanut Grove Park, Block L, Miami FL. 2. On September 23 2005, a Unity of Title Agreement (CFN: 20160570867 Book 30250 Pg. 2678 was created by the previous property owners of 3600 Hibiscus St, (known today as 3501, 3511 and 3521 Avocado Avenue), to unify lots 10, 11 and 12 (comprised of 21000 sq. ft. lot) in order to accommodate the expansion of an existing house, built in 1956. The document was recorded on County. D October 8, 2005, in official records book 3857, page 3354, of the public records of Miami -Da de 3. On December 21, 2015, a Demolition Order was issued for 3600 Hibiscus St and the house was demolished (Permit #BD 15-016491-001-B001). An Archeological Monitoring was issued to supervise the demolition. 4. On August 01, 2016, the applicant submitted plans for review and approval of the Building Department. (Structural, Mechanical, Plumbing, Environmental, Flood, PW). The plans consisted of 3 residences located at 3501, 3511 and 3521 Avocado Avenue, Miami, FL. 5. On September 23, 2016, the plans were internally routed to the Zoning Department for review. 6. On September 28, 2016, 3501 AVOCADO AVE (BD16-010787, 001)-was stopped by Diana Agudelo in her review of this building application for construction. 7. On September 28, 2016, 3511 AVOCADO AVE (BD16-010785-001)-was denied by Diana Agudelo in her review of this building application for construction. 8. On September 30, 2016, the applicant dissolved the Unity of Title, through the Clerk of Courts of Miami -Dade County. ( With the dissolution of the unity of Title, the 1t s were reverted back to its original lot configuration, as shown in Microfilms for CocoanutGrove Park. The site was dismembered into 3 separate lots comprised of 7000 sq. ft. each, legally plated and recorded by the County (See Paragraph 3 of CFN: 20160570867, Book 30250 Page 2678). Moreover, GIS shows only 2 Folio numbers; lot 10, with 7000 sq. ft., and lots 111 and 12 as one lot comprised of 14000 Sq. Ft. 9. On October 4, 2016, 3521 AVOCADO AVE (BD16-010783-001)-was denied by Carlos Herrera in his review of this building permit application for construction. 10. On October 4, Zoning sent the application back to Building, and Building called the applicant on October 14 to pick up the plans in order to make the appropriate reviews for a resubmission. 11. On October 19, 2016, the applicant's runner (Eugene) picked up the plans at ZoningDepartment. p artm ent. 12. On November 04, 2016, the Planning and Zoning Department received the Warrant application for review and approval. 14. Between November 07 and November 20, pre-app meetings between the Z.A and the applicant occurred at the Zoning Department. 15. On November 23, 2016, Zoning referred the Warrant application to Planning, for review and approval. A pre-app meeting between the Planning Department and the applicant occurred on December 02, 2016. 16. On December 05 2016, the applicant resubmitted the plans at Building Dept. for review of mechanical discipline. 17. On December 08, 2016, the applicant resubmitted plans at Building Dept. for review of Environmental discipline. Building forwarded the plans to Environmental at the same day. Y 18. On December 09, 2016, Environmental finalized their review and sent it back to Building Dept. 19. On December 12, 2016, Building Department called the applicant to pick up the plans in order to make appropriate review and resubmittal. The Unity of Title provides, in pertinent part the following statement: "... it is understood and agreed that the transfer of Parcel is and was conditioned upon John & Joseph Corp. executing in recordable form a Unity of Title Agreement combining the Parcel One and Parcel Two, with the further understanding that said Unity of Title Agreement is to include restrictive terms prohibiting the resulting property from being utilized for other than one single family residence; 1. That said property shall be considered as one plot and parcel of land and that no portion of said plot and parcel of land shall be sold, transferred, devised or assigned separately, except in its entirety as one plot or parcel of land. 2. That said property subject to this Unity of Title Agreement shall not be utilized for other than one single family residence thereon." Based on analysis and aforementioned findings, staff concludes that it was the intent of the previous owner to maintain lots 10, 11 and 12 into one building site comprised of 21000 square feet. Moreover, pursuant to Miami 21 Code, Appendix A-NCD-3, Section 3.6.g.1 states the following: Lots and building sites: Wherever an existing single-family residence or lawful accessory building(s) or structure(s) is Located on one or more platted lots or portions thereof, such lots shall thereafter constitute only one building site and no permit shall be issued for the construction of more than one single-family residence except by Warrant" ..... Two (2) other residences are proposed at adjacent lots, by the same owner, within two (2) existing platted lots of the Parkdale subdivision, block 11. Separate applications are attached hereto. Previously, all three (3) lots were occupied by one large residence. ots were previously joined iginally, the end of this block of the Parkdale subdivision was designed igned to sustain three (3) separate single-family residences, with a N-S orientation. A demolition permit was obtained by the previous owner, and the previous house removed prior to our involvement. The waiver for demolition was approved was accompanied with a tree resource evaluation by a certified arborist pursuant to MIAMI 21, NCD-3 SEC 3.3. The primary frontage for the new construction was determined by city staff Manny Torrado. The primary frontage was determined to be along Avocado and the new address assigned to the home reflected the same. Staff determination concurred with our own study— that the adjacent property frontages along Loquat were used primarily for off-street parking; consisted of one and two-family dwellings; the massing was consistent for overhangs, porte coheres and legally non -conforming carports. Existing conditions along Avocado Avenue promoted it as the primary street, for reasons not limited to: massing, walk -ability, character and footprint of the existing residences, including those original and recently -constructed. A considerable and intensive tree resource evaluation was made by arborist Jeff Shimonski, of Tropical Designs of Florida to also aid in determining frontages and massing. Shimonski is a Member of the American Society of Consulting Arborists, and a Certified Arborist Municipal Specialist, FL-1052AM. Shimonski performed an ISA Tree Risk Assessment Qualification Shimonski for all three properties. A copy of the report is attached to the permit application, and Shimonski can be contacted at P.Q. Beginning Spring of 2016, our office commenced a considerable and intensive a study of the neighborhood in order to establish three (3) dissimilar homes, that were substantially differentiated in massing, footprint, and exterior detailing, and complied with the intention of the requirements set forth in MIAMI 21, NCD-3 SEC 3.6, which states: "Adjacent lots or lots in the same subdivision under single ownership, or developed by a single builder or developer shall not employ the same, similar or duplicate architectural plans. " Concluding in July 29, 2016, our office provided three unique designs, with special consideration of the existing median(s), green space(s), landscape, tree disposition and road configuration contributing to the existing and historic character of the Parkdale subdivision. Our study concluded at a new residence could be built by removing only trees that were determined in the arborist's report to be sustainably damaged, ill or those that posed substantial risk to public safety. The final design for this home employed open terraces that rest within an extensive canopy of existing Alexander, Christmas and Palmetto palms, a large opening and overhang at the primary facade with faceted fenestrations at both levels, creating a 2-level open proscenium intended to reduce the scale and disambiguate the envelope of the building, connecting the natural and built environments. INTRODUCTION Miami 21, Appendix A, includes three Neighborhood Conservation Districts (NCDs), the NCD-1, NCD-2, and NCD-3. The focus of this Warrant is a building site located within the NCD-3 Overlay in Coconut Grove. Throughout the years, the development within Coconut Grove has been influenced by common factors of economic, social, and cultural trends that have generated interest to move and develop in the neighborhood. Coconut Grove represents an area of the City where the majority of Lots exceed the current minimum buildable Lot size of 5,000 square feet within a T3-R Transect Zone. Historically, the development pattern of the area has produced an assemblage of Lots into larger building sites. These building sites often consist of multiple Lots that exceed the minimum allowed Lot size of 5,000 square feet for the T3-R Transect Zone within the City of Miami. Recently, development trends have deviated from the typical development pattern of Coconut Grove. These trends seek to disaggregate Lot assemblages and diminish the large building sites into smaller building sites commensurate to the formerly aggregated site. Some methods employed to disaggregate the building sites include: total demolition, dissolution of unity of title, covenant in lieu of title, and re -platting. While the diminishment of a building site may be permissible through the Warrant Permit process, the current development trend poses notable concerns to the existing character of Coconut Grove. The Coconut Grove's emerging development trend toward disaggregated, diminished lots is inconsistent with the intent of the NCD-3 Overlay which states, "The single family residential district is intended to protect the low density residential and dominant tree canopy characteristics of Coconut Grove and prevent the intrusion of additional density, uses, and height." ANALYSIS OF A WARRANT PERMIT TO ALLOW BUILDING SITE DIMINISHMENT History of 3600 Hibiscus Avenue On September 17, 1956, a single-family residential structure was constructed on Lots 11 and 12 (3600 Hibiscus St.), located within Cocoanut Grove Park, Block L, Miami FL. A Unity of Title Agreement (CFN: 20160570867 Book 30250 Pg. 2678) was created by the previous property owners of 3600 Hibiscus St. (known today as 3501, 3511, and 3521 Avocado Avenue), to unify lots 10, 11, and 12 in order to accommodate the expansion of an existing house. The Unity of Title Agreement is dated September 23, 2005, and recorded on October 8, 2005, in official records book 3857, page 3354, of the public records of Miami -Dade County. The following is an excerpt extracted from the dissolved Unity of Title, which provides, in pertinent part the following statement: "... it is understood and agreed that the transfer of Parcel is and was conditioned upon John & Joseph Corp. executing in recordable form a Unity of Title Agreement combining the Parcel One and Parcel Two, with the further understanding that said Unity of Title Agreement is to include restrictive terms prohibiting the resulting property from being utilized for other than one single family residence; 1. That said property shall be considered as one plot and parcel of land and that no portion of said plot and parcel of land shall be sold, transferred, devised or assigned separately, except in its entirety as one plot or parcel of land. File No. 2017-0002 2. That said property subject to this Unity of Title Agreement shall not be utilized for other one single family residence thereon." Based on the above excerpt from the Unity of Title, the intent was to maintain lots 10, 11, and 12 as one building site comprised of 21,000 square feet. On December 21, 2015, a Demolition Order was issued for 3600 Hibiscus St and the house was demolished (Permit #BD15-016491-001-B001). Archeological Monitoring was required to supervise the demolition. On September 30, 2016, the applicant dissolved the Unity of Title, through the Clerk of Courts of Miami -Dade County. The site was dismembered into three (3) separate lots comprised of 7,000 sq. ft. each, legally platted and recorded by the County (See Paragraph 3 of CFN: 20160570867, Book 30250 Page 2678). Moreover, G!S shows only two (2) Folio numbers; lot 10, with 7,000 sq. ft., and lots 11 and 12 as one lot comprised of 14,000 sq. ft. NCD-3 Development Standards The following is a review of the request using the development standards of Miami 21 Code, Appendix A, Section 3.6, Single Family Residential District. Landscaping One of the purposes of NCD-3 is to preserve and to protect the historic, heavily landscaped character of Coconut Grove's residential areas, as well as to enhance and protect Coconut Grove's natural features, such as tree canopy and green space. The applicant has submitted a landscape plan as well as a tree mitigation and disposition plan for the site. Staff believes the proposed landscape negatively affects the existing landscape as it includes non-native species. and is not aligned with the intent of the NCD-3 Overlay. A more extensive landscape plan is required to be submitted. Site and Building Disposition As part of the Warrant submittal materials, the applicant provided conceptual plans that include the construction of three (3) single-family residences (one on each of the proposed lots). Pursuant to Miami 21 Appendix A, NCD-3, Section 3.6 requires, "that adjacent lots or lots in the same subdivision under ingle ownership or developed by a single builder of developer shall not employ the same, similar or duplicate architectural plans". Miami 21 Appendix A, NCD-3, Section 3.6 (a) states that, "Adjacent buildings under such conditions shall be substantially differentiated in massing, footprint, and exterior design". The conceptual residence renderings provided by William Hamilton Arthur Architect INC, shows three two-story, single-family structures with varying lot coverage. On Lot 10 the lot coverage is 3,863 square feet, on Lot 11 the lot coverage is 3,707 square feet, and on Lot 12 the lot coverage is 3,562 square feet. The proposed conceptual dwelling units display dissimilar architectural styles and finishes. However, the dissimilarity needs to be increased, in order to meet the intent of the NCD-3. There is a mix of housing types in the neighborhood and it is unusual to find three two-story residences in a row on Avocado Avenue. As depicted, staff finds that the conceptual renderings and site plan are not compliant with the Miami 21 Code development standards of the NCD-3. Neighborhood Context When examining the neighborhood context of the subject site, the Lot size and configuration has changed over the years. The subject building site at approximately 21,000 square feet represents an example of the neighborhood's evolution from the uniform Lots of the Coconut Grove Park File No. 2017-0002 Subdivision into an assortment of larger Lot sizes and configurations. Until recently, the neighborhood context trended toward larger Lots that in turn reduced the density, traffic, and infrastructure demands of water and sewer. Therefore, the request to revert the subject building site into three Lots is considered contrary to the conservation and preservation component of the NCD-3. Staff's research of the neighborhood composition revealed that 18 Lots abut Avocado Avenue between Hibiscus Avenue and Plaza Street, of which five (5) Lots have been modified from their original plat. Concurrently, staff examined the same Lots along Avocado Avenue (between Hibiscus Avenue and Plaza Street) and found an average Lot size of 8,744 square feet. When analyzing Lots within a 250-foot radius of the subject site, it was found that the average Lot size was 8,940 square feet. For Lots within a 500-foot radius of the subject building site, there exists 71 Lots with an average Lot size of 8,586 square feet. In addition, 29 Lots within 500-foot radius have been modified from their original Lot size. The average square footage of modified Lot size is 11,256 square feet. The evaluation of the neighborhood context shows that many Lots have been aggregated resulting in less dense area. The proposed diminishment of the subject building site from 21,000 square feet to three 7,000 square feet Lots will increase the neighborhood's density, generate additional traffic, and increase demands of infrastructure, which is inconsistent with the conservation element of the NCD-3. Reverting the existing building site to its three originally plated Lots of 7,000 square feet each would be out of character with the surrounding neighborhood. FINDINGS Pursuant to the Miami 21 Zoning Code, Appendix A, NCD-3, Section 3.6(g)(1), Lots and building sites, as adopted, which states, "Wherever an existing single-family residence or lawful accessory building(s) or structure(s) is located on one or more platted lots or portions thereof, such lots shall thereafter constitute only one building site and no permit shall be issued for the construction of more than one single-family residence except by Warrant. Such structures shall include but not be limited to swimming pools, tennis courts, walls, and fences or other at grade or above ground improvements. No building sites in existence prior to September 24, 2005 shall be diminished in size except by Warrant, subject to criteria specified in Article 4, Table 12 Design Review." This project shall comply with Miami 21, Appendix A, Section 3.6 Single -Family Residential District for lots located within Transect Zones designated as T3-R (Sub -Urban Restricted) Single-family Residential. • On September 17, 1956, a single-family residential structure was constructed on Lots 11 and 12 (property known as 3600 Hibiscus St), establishing a unified building site of approximately 14,000 square feet. The unification of building sites is consistent in the immediate neighborhood as almost half of the building sites exceed their original platted size of 7,000 square feet. • On September 23, 2005, a Unity of Title Agreement (CFN: 20160570867 Book 30250 Pg. 2678) was created for 3600 Hibiscus St, (known today as 3501, 3511, and 3521 Avocado Avenue), to unify lots 10, 11, and 12. With the unification of Lot 10 to Lots 11 and 12, the square footage of the building site increased from 14,000 to 21,000 square feet of land. The unification of building sites is consistent in the immediate neighborhood as over half of the building sites exceed their original platted size of 7,000 square feet. • The intent of the NCD-3 Overlay, Single -Family Residential District is to protect the low density residential neighborhood and dominant tree canopy characteristics of Coconut Grove, and to prevent the intrusion of additional density, uses and height. Granting the request to revert to the three original building sites does not comply with the intent to protect the low - density neighborhood. File No. 2017-0002 • The Warrant request is to diminish the existing building site of approximately 21,000 square feet by reverting the site to the three original platted lots of approximately 7,000 square feet each. The request is inconsistent with the context along Avocado Avenue between Hibiscus Street and Plaza Street, where building sites have an average Lot size of 8,744 square feet. Furthermore, the average square footage of modified lot size within 500-foot radius is 11,256 square feet. Therefore, the request does not comply with Article 4, Table 12 in reference to the urban form criteria. • The proposal consists of the construction of two-story dwelling units on Avocado Avenue, which is predominately developed with one-story residences. As presented, the proposal represents development out of character with the neighborhood context. Conclusion Pursuant to Article 7, Section 7.1.2.4(d) of the Miami 21 Code, and Appendix A of the Miami Zoning Ordinance, the Warrant Permit application to diminish an existing building site has been reviewed. Specifically, the applicant requests to diminish the existing building site by reverting to the three original platted Lots of 7,000 square feet each to three new building sites. As proposed, each of the three new building sites will have a size of 7,000 square feet, which is the same as the originally platted Lot size. However, at 7,000 square feet, the building sites will be disproportional to the existing neighborhood's building site composition and context. Additionally, the proposal does not align with the intent of the NCD-3 Overlay, which is to protect the low -density residential character of Coconut Grove and to prevent the intrusion of additional density, uses, and height. Based on the above findings and analysis pursuant to Article 7, Section 7.1.1.2 of the Miami 21 Code, the Staff recommends Denial of the subject Warrant application to diminish and revert the existing building site into the three original platted Lots of 7,000 square feet each, to create three new building sites.
