Dear Members:
I am the owner of the property located at 4237 W Flagler. My property neighbors
the applicant's property and abutting the above alley. It is my understanding that a
deferral is being requested by another neighboring property owner. In another letter to
Mr. Francisco Garcia, Director of the City of Miami Planning Department, I offered my
support for the Alley Closure based upon a review of documents provided to me by the
developer, conversations with the developer and promises made by the developer to
review with me the project's Maintenance of Traffic plan and plans for alternative access
prior to commencing construction. While I do not object to the request for the deferral, I
see no reason why the alley closure request should not be heard at the Planning, Zoning,
and Appeals Board meeting of July 19, 2017. Based upon everything I have been told by
the developer and my review of the documents provided to me, I believe that the
proposed development will be beneficial to the area, and the proposed easement will have
no adverse effect on access through the alley area due to the proffered public access
easement.

Dear Mr. Garcia,
I am the owner of the property located at 4237 W Flagler. My property neighbors
the applicant's property and abutting the above alley. I offer this letter as my show of
support for the closure of a portion of the alley located along the West side of NW 42
Avenue, from West Flagler Street to NW 1 Street. I have reviewed documents provided to
me by the developer regarding the proposed alley closure and the proffered easement and
based upon a review of the provided documents, I am in favor of the Planning, Zoning,
and Appeals Board resolving to recommend the alley closure.
This alley, as currently configured, provides limited pedestrian access. Based
upon the documents provided and conversations with the Developer, it is my
understanding that the applicant will provide a three dimensional easement in the
footprint of the original alley which will ensure public ingress and egress for both
automobiles and pedestrians while maintaining the current access point. The reason I am
offering my support for this alley closure is that the applicant has promised to provide
widened sidewalks and an enhanced pedestrian realm to create a safer, more efficient
pedestrian experience, while maintaining automobile access through the alley.
As an immediate neighbor, I request that the Planning, Zoning, and Appeals
Board recommend approval of the requested alley closure. Thank you.

Castle Mount is the owner of the property located at 4231 W. Flagler Street, Miami,
Florida, which property is west of and immediately adjacent to the property owned by
Applicant, Keystone Havana Club, LLC. The affiliate of the Applicant is the tenant of
4231 W. Flagler Street.
On July 12, 2017, Castle Mount, through its representative Martin W. Schlosberg
trustee, received notice of the hearing. This is the first notice (actual or
constructive) that Castle Mount received of the proposed alley closure.

The applicant failed to disclose that the property owned by the applicant, which runs
along the alley proposed to be dosed, is part of a unified site. The unified site includes
the applicant's two story building which is physically attached to objector Castle Mount's
seven story building (believed to share common mechanical and fire safety systems
inter alia ) and the lots for the required parking, as shown below:

The above unified site plan is documented in the records of the City of Miami. The site
was built under City of Miami Building Permit #BD16-012631-01-B001. It was originally
the Republic National Bank and was recently the Regions Bank facility. Objector Castle
Mount's seven story building serves as an office building, remains occupied and
continues to use the parking lots that are adjacent to the alley the applicant seeks to
close. These lots constitute required parking according to the unified site plan which is
part of the approved plans for the objector Castle Mount's building at 4231 W. Flagler
Street.
The functioning of the unified site, and access and egress to the seven -story office
building will be directly and may be adversely impacted by the proposed alley closing to
which Castle Mount has not consented.
With only seven days' notice, the objector Castle Mount does not have sufficient time to
retain traffic engineers, economists, property appraisers, planners, architects and other
consultants to demonstrate the adverse impacts of the proposal. Most importantly, the
proposed closing of the alley is not consistent with the approved unified site plan.
I respectfully request that the matter be continued to either the July 31, 2017 or
the September 6, 2017 PZAB hearing in order to allow time for Castle Mount to
retain experts to study the project, to meet with the Applicant to address these
and other issues related to the project and in order to discuss an amicable
resolution of the issues, and to submit expert reports, if appropriate.

represent Castle -Mount Investments, inc., the authorized agent for the owner of the
seven -story office building located at 4231 W. Flagler Street, Miami, Florida, 33134-
1605, (Folio #01-4105-027-0200.) That seven -story office building is physically
attached to a two-story building located at 10 NW 42nd Avenue, Miami, Florida, 33126-
5473, (Folio #01-4105-027-0190.) and owned by Keystone Havana Club, LLC. In fact,
the seven -story building was built, according to City records, as an "addition" to the two
story office building. The seven -story building is occupied.
In the past week, we discovered that the City is processing Keystone Havana Club,
LLC.'s application for a Building Permit for the demolition of the attached adjacent two-
story building, (BD16-012631-001-B001.) Neither the owner of the property proposed to
be demolished, nor the City, has put my client on notice of the intent to demolish the
two-story building that is attached to my client's seven -story building.
Looking at the architectural demolition plans, the architect notes that the seven -story
building is "NOT A PART" which is misleading, see Sheet D-1, Composite Exhibit A.
The plans do not show that the components of the two buildings are integrated and that
they are part of one multi -lot site plan.
We are still investigating this proposal but feel it is necessary to put the City on notice
now about potential adverse effects of the proposed demolition and development on my

client. The application should not be granted until we meet and consent. It is our
position that the demolition cannot proceed until and unless we consent.
When the seven story building was approved (four-story addition on top of a three-story
building) it was part of a multi -lot site plan. A copy of the site plan is attached as Exhibit
B. The site includes parking spaces for use by the two buildings. Please note that the
site plan included both the two story building now proposed to be demolished, and the
seven -story building now owned by my client as well as the parking spaces.
The history of the site is interesting. Prior to the site plan with the seven -story building,
a multi -lot site plan had been approved for a three-story building where the seven -story
building is now; the three-story building was an addition to the current two-story
building. Then the seven -story building was constructed by placing a four-story
addition on top of the three-story building.
We are very concerned about this proposed demolition and any proposed development
that may interfere with my client's use of the seven -story building and parking spaces as
is presently allowed under the approved site plan.
We request a meeting with you promptly to review the proposed demolition and
development plans for the site, and discuss our concerns fully. In the interim, we
request that no permit be approved by your department without giving us reasonable
notice, an opportunity for us to understand the proposed construction, and for you to
consider our concerns about the proposal,
