On behalf of the Applicant, we respectfully submit the enclosed Vacation and Closure Application for a portion of the alley which traverses the Property as located between NW 42 Avenue and NW 43 Avenue (the "Alley Closure") and as depicted in the image below. WWW.GTLAW.COM 333 S.E. 2nd Avenue • Suite 4400 m Miami, FL 33131-3238 ■ Tel 305.579.0500 • Fax 305.579.0717 10 NW 42 Avenue, Miami, Florida Alley Closure Letter of Intent The Property is currently being platted pursuant to the KEYSTONE HAVANA CLUB Tentative Plat (# 1897), which received approval at the Plat and Street Committee meeting on May 4, 2017. The purpose of the replat is to vacate the alley at the Property, in order to permit construction of a mixed use structure. A three dimensional public access easement is being proffered in the original footprint of the portion of the alley to be vacated, which will provide ingress and egress for the public. This will be a platted easement which is included in the tentative plat. Further, the Plat and Street Committee voted in favor of approving the vacation and closure of the alley and has issued a recommendation of approval to the Planning, Zoning, and Appeals Board. The Plat and Street Committee determined that the application for alley closure meets the criteria established in Section 55-10 of the City Code. I. Is it in the public interest, or would the general public benefit from the vacation of the right of way? Vacation and closure of the alley would remove this portion of the alley from the City's maintenance schedule, removing a burden on City services and the taxpayers. Furthermore, the portion of the alley to be vacated will be replaced by a three dimensional easement, permitting public ingress and egress. The easement area will be beautified as part of the development at the parcel, with improvements made to the curb cut as well as the pedestrian experience through an enhanced sidewalk both in the public right of way as well as within the private property. II. Is the general public no longer using the right of way, including public service vehicles, fire, or other emergency vehicles? The portion of the alley being vacated will be replaced by a public ingress and egress easement, which will maintain the current level of access through this portion of the alley. As noted by the Fire and Solid Waste Departments, the alley is not being utilized for public service vehicles; however, in the event they choose to utilize the alley, there will be no restriction on access as the public access easement will be in place. III. Would there be no adverse effect on the ability to provide police, fire, or emergency services? As noted above, public service vehicles are not utilizing the alley; however, the public access easement will ensure that there is no adverse effect. Would the vacation and closure of the right of way have a beneficial effect on pedestrian and vehicular circulation in the area? Through the platting process, subdivision improvements will be made which will improve circulation and the pedestrian realm along the public right of way. Additionally, circulation will be improved within the alley area with the inclusion of an improved sidewalk on the private property portion. As part of the proposed development, sidewalks will be placed on both sides of the alley within the private property, where only a single sidewalk exists on the south side of the alley (see image below). Two sidewalks will decrease the interaction between pedestrians and vehicles, improving circulation. For the reasons stated above, and in connection with the City Plat and Street Committee's recommendation of approval of the alley vacation, we submit the enclosed Vacation and Closure Application for the portion of the alley located at 10 NW 42 Avenue.
