I have included the latest version of the landscaping plans for 3140 Day Avenue and have addressed the
requested revisions that you have outlined below.
As you are aware, our initial plans were posted and accepted by the City of Miami. We are now
addressing the concerns that have arisen out of appeal by Mr. Kurland.
Comment #1
<Michael's comment> Please have your surveyor re -check the locations of the trees, sidewalk and
building corner. Especially with respect to the southwest corner of the property, based on aerial
photos it seems that the sidewalk, closest oak and building corner do not correspond (on relative
distance terms) to where they show on the plans.
<Response> Both our Surveyor and Architect have reviewed and addressed the concerns of Comment
#1.
Tree #9 and Tree #10 have been updated on the survey to reflect their proper position along the
property line on both the survey and the plans (attached).
Comment #2
<Michael's comment> Please propose an alternate construction method for the sidewalk construction
so that it is at -grade (no ground disturbance) within 15 feet of any tree, or obtain a waiver to avoid
constructing it altogether (as traditional construction of the sidewalk would likely kill the larger oaks)
<Response>Please see alternate construction method on Landscaping plans as outlined by the City of
Miami Public Works Department representative Paul Rodas P.E. (see attached for complete e-mail)
Hello Mrs. Rothe,
We will be moving forward with requiring a narrower 3 foot wide sidewalk within vicinity of the tree, and push that
narrow sidewalk outward so that the outer edge is 6 inches away from the edge of the inlet's grate. The following
measures are to further protect the tree:
1. Sidewalk to maintain a standard thickness of 4 inches (6 inches at driveways). Reinforce with welded wire mesh
and avoid construction/expansion joints within 2 feet of shallow roots. Cover shallow roots with a 2 foot wide
section of filter fabric prior to concrete pour. Where necessary utilize 3/8 inch pea gravel (rounded edge) for fill
material adjacent to shallow or exposed roots.
2. Sidewalk cross slope is not to exceed 2% cross slope or 5% pitch in the direction of travel.
3. No cutting or pruning of the root system of tree.
As to the issue of the neighboring pavers, I am waiting to consult the Director on Tuesday when he is back in the
