Background of Item: In December 22, 2016, the City entered into a lease agreement with Miami -Dade County to lease a certain tract of land located at the northeast corner of the intersection of the Metrorail and Metromover systems and W. Flagler Street, approximately 60 feet west of Southwest 1st Avenue, as more particularly described in Exhibit "A" of the Lease Agreement (the "Property"). As such, the City intends to construct and connect to the County's water and sewer systems one (1) public bathroom and the County has agreed to the City's work, subject to the terms, covenants and conditions contained in the Lease Agreement. Therefore, in order for the Office of Capital Improvements ("OCI") to obtain permitting approval from WASD and perform the work at the Property, an agreement must be executed between WASD and the City. The cost for the service and connection charges is $2,236.80, which will be paid utilizing funds from capital project B-506775, DDA Bathrooms for the Homeless - Sanitary Sewer. B-50677S. WHEREAS, on October 13, 2016, the City of Miami ("City") Commission adopted Resolution No. 16-0484 which authorized the City to enter into a lease agreement ("Lease Agreement") with Miami -Dade County ("County") for the property located at the northeast corner of the intersection of the Metrorail and Metromover systems and West Flagler Street, approximately sixty feet (60') west of Southwest 1st Avenue, Miami, Florida, as more particularly described in Exhibit "A" of the Lease Agreement ("Property"); and WHEREAS, the County's Water and Sewer Department ("WASD") provides water and sewer services for the City including at the Property; and WHEREAS, the County has agreed to the City's Project subject to the terms, covenants, and conditions contained in the Lease Agreement; and WHEREAS, the City intends to construct one (1) public restroom on the Property and connect it to the County's water and sewer systems to provide sanitary sewer service for the Downtown Development Authority's ("DDA") public restroom, Capital Improvements Program Project B-50677S ("Project"); and WHEREAS, the restroom will be staffed at all times by a member of the DDA's Downtown Enhancement Team which includes formerly homeless individuals who now work to ensure the streets of Downtown Miami are clean; and WHEREAS, the City Manager requests authorization to execute an agreement, in substantially the attached form, with WASD for water and sanitary sewer services for said Property ("Agreement"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to execute an Agreement, in substantially the attached form, with WASD for the provision of water and sanitary sewer services for the DDA's public restroom, Capital Improvements Program Project No. B-50677S. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity ttor ey 7118/2017 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
