HomeMy WebLinkAboutR-17-0360City of Miami Resolution R-17-0360 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 2616 Final Action Date: 7/27/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), GRANTING THE APPLICATION FOR A HISTORIC AD VALOREM TAX EXEMPTION, BASED ON THE RECOMMENDATION OF THE HISTORIC AND ENVIRONMENTAL PRESERVATION BOARD, TO JESSICA SPAIN ("OWNER") FOR THE PROPERTY LOCATED AT 428 NORTHEAST 73RD STREET, WITHIN THE PALM GROVE HISTORIC DISTRICT. WHEREAS, Chapter 23, Article II of the Code of the City of Miami, Florida, as amended ("City Code"), entitled "Historic Tax Exemption Ordinance," authorizes the City Commission to grant tax exemptions to owners of historic properties within the City of Miami ("City") under specified conditions, and for a period of up to ten (10) years; and WHEREAS, the City Commission, at its meeting on June 21, 2007, adopted Ordinance No. 12927, allowing owners of locally historic designated properties who make improvements to their properties to have the taxes levied by the City on the increased value of the improvements exempted for a period of up to ten (10) years; and WHEREAS, Jessica Spain, the owner of the historic property located at 428 Northeast 73rd Street, Miami, Florida, with a legal description as set forth in the attached "Exhibit A" ("Property"), has submitted an application for a tax exemption pursuant to the City's Historic Tax Exemption Ordinance; and WHEREAS, the City's Historic Preservation Officer ("Preservation Officer"), upon review of the application materials, has determined that the Property complies with the requirements in the City's Historic Tax Exemption Ordinance, and has recommended that the application be granted; and WHEREAS, to qualify for an exemption, the property owner must enter into a Historic Property Tax Exemption Covenant or agreement ("Covenant") with the City providing that the "qualifying improvements to the property be maintained during the period that the exemption is granted," in substantially the form attached as "Exhibit B"; and WHEREAS, the Miami Historic and Environmental Preservation Board ("HEPB"), at its meeting on May 7,2013, following an advertised public hearing, adopted Resolution No. HEPB- R-13-024 by a vote of nine to zero (9-0), Item No. HEPB.8, recommending approval of the application for Ad Valorem Tax Exemption for Historic Properties Part I "Exhibit C"; and WHEREAS, the HEPB, at its meeting on April 7,2015, following an advertised public hearing, adopted Resolution No. HEPB-R-15-022 by a vote of six to zero (6-0), Item No. HEPB.5, recommending approval of the application for Ad Valorem Tax Exemption for Historic Properties Part II "Exhibit D"; City of Miami Page 1 of 2 File ID: 2616 (Revision:) Printed On: 3/24/2025 File ID: 2616 Enactment Number: R-17-0360 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City hereby grants the Property an ad valorem tax exemption pursuant to the City's Historic Tax Exemption Ordinance. Section 3. This approval is conditioned on the execution by the property owner of a covenant in the form attached as "Exhibit B." Section 4. The Covenant shall be recorded by the Applicant in the Official Records of Miami -Dade County within thirty (30) days of approval of this Resolution. Section 5. The tax exemption granted herein shall remain in effect for ten (10) years. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'
