Qrk NE NE 37TH ST• NE 35TH 3704 NE 2nd Avenue • Recommend Approval of PZAB recommendation to not allow murals in the Design District Special Area Plan "SAP" • Amend "Exhibit B" to allow two properties to maintain their vested mural rights that are currently allowed to have murals and are not in the "SAP". • City Attorney and City Planners are on record at PZAB meeting 04/05/17 that they have no objections. • City Commission has stated in the past that "outdoor advertising is not good in our neighborhoods, but on the expressways, we can live with them" (Commission Meeting 05/13/2010). • Removing an existing mural right from these properties does not eliminate a mural. The permit will just be moved elsewhere in a residential area of the urban core. • This will result in reduced revenue to the City. 1m1- SvbwaAa,-NINP 5c\ -X\A.A. - 90ynscdmag5 Current Submitted into the pub'. record far itel s on � 1�3 � • City Clerk • 3704 NE 2"d Ave has an existing mural permit. • 100 NE 38th St had a mural permit issued January 2015. • The city issued a building permit August 2015 for 100 NE 38th St to erect a structure to hold a mural. • The mural permit holder decided in August 2016 to move his permit after learning of Dacra's desire to eliminate or restrict permits on this property. • The building owner has initiated plans to redevelop the property supported by a vested mural right. • Given the $45K/space expense of the Design District Parking Improvement Trust, having a vested mural right, even if in the future the mural program is eliminated makes redevelopment more of a reality.
