Dear Ms. Zamora:
As you are aware, this law firm represents MacArthur Properties III, LLC
("Applicant") with regard to the properties located at 3701 Biscayne Boulevard, 3737
Biscayne Boulevard, 306 NE 38 Street, and 316 NE 38 Street in Miami, Florida (the
"Property"). See Exhibit A. On July 13, 2015, the Applicant submitted an application to
rezone the Property from T6-12-L to T6-12-0, which is identified by File ID Nos. 15-
00975zc and 1126 ("Rezoning Application"). This letter shall serve as the Applicant's
formal withdrawal without prejudice of the Rezoning Application and request to obtain
a refund of the submitted application fees.
Rezoning Application History. The Applicant submitted the Rezoning
Application on July 13, 2015. Accordingly, the Applicant was invoiced and paid the
required application fees in the amount of $28,773.90 pursuant to City of Miami ("City")
Code of Ordinances ("Code") Section 62-22. See Exhibit B.
The Planning and Zoning Department issued a recommendation of approval for
the Rezoning Application. The City's Planning, Zoning, and Appeals Board ("PZAB")
considered the Rezoning Application on September 2, 2015, and voted to recommend
approval of the Rezoning Application. Thereafter, the Rezoning Application was
scheduled for hearing before the City Commission on October 22, 2015, at which time the
Rezoning Application was continued and was not considered. The Rezoning Application
was subsequently deferred on October 22, 2015; November 19, 2015; January 28, 2016;
April 28, 2016; June 23, 2016; September 22, 2016; and October 27, 2016. On January 26,

2017, the Rezoning Application "indefinitely deferred" without having been considered
by the Commission.
Requests. The Applicant seeks a withdrawal without prejudice of the Rezoning
Application as well as a refund of the submitted application fees. Article 7, Section
7.1.2.8.g.6 of Miami 21 provides as follows:
Whenever an applicant has voluntarily withdrawn an
application for rezoning of property during either first or second
reading before the City Commission, the Planning, Zoning and
Appeals Board shall not thereafter consider an application for
the same property for eighteen (18) months from the date of
such action, nor consider an application for any kind of
rezoning of any part or all of the same property for twelve (12)
months from the date of such action.
(Emphasis added). Accordingly, since the City Commission has merely deferred the
Rezoning Application and has not yet heard or decided the Rezoning Application at first
reading, the eighteen (18) month limitation on further consideration after voluntary
withdrawal provision has not been triggered. Thus, neither the eighteen (18) month
limitation related to the Property, nor the twelve (12) month limitation for any application
including the Property, are applicable.
This letter confirms that the foregoing limitations are not applicable, and in
reliance on this confirmation, the Applicant formally withdraws the Rezoning
Application without prejudice and requests a refund of the associated application fees.
