A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH MIAMI-DADE WATER AND
SEWER DEPARTMENT FOR THE PROVISION OF WATER AND SANITARY
SEWER SERVICES FOR MORNINGSIDE PARK SANITARY SEWER
REPLACEMENT, CAPITAL PROJECT B-30839S.
WHEREAS, the City of Miami ("City") intends to replace a sewer lateral for the toilets in
an existing restroom at Morningside Park located at 750 N.E. 55th Street, Miami, Florida
("Property") as a part of the project known as Office of Capital Improvement Morningside Park
Sanitary Sewer Replacement, Capital Project No. B-30839S ("Project"); and
WHEREAS, the Miami -Dade County Water and Sewer Department ("WASD") provides
water and sewer services for the City at the Property; and
WHEREAS, in order for the City to obtain permitting approval from WASD for the Project
at the Property, a water and sanitary sewer agreement ("Agreement") must be executed
between WASD and the City; and
WHEREAS, the City Manager requests authorization to execute the Agreement, in
substantially the attached form, for water and sanitary sewer services from WASD for said
Property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Agreement, in substantially
the attached form, with WASD for the provision of water and sanitary sewer services at the
Property for the Project.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
