PURPOSE: Provides clarification of existing regulations related to Civic Space Transect Zones
(CS), shall conform to any master plans adopted by the City Commission.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING
ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, AS AMENDED, SPECIFICALLY BY AMENDING ARTICLE 4,
TABLE 4, ENTITLED "DENSITY, INTENSITY, AND PARKING," AND
ARTICLE 5, SECTION 5.7, ENTITLED "CIVIC SPACE ZONES AND CIVIC
INSTITUTION ZONES," TO CLARIFY REGULATIONS RELATED TO CIVIC
SPACE ZONES; CONTAINING A SEVERABILITY CLAUSE AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on October 22, 2009, Ordinance No. 13114, the Zoning Ordinance of the City of
Miami, Florida was adopted as the City of Miami's ("City") Zoning Ordinance ("Miami 21 Code"); and
WHEREAS, pursuant to the Miami 21 Code, development in Civic Space ("CS") Transect
Zones is subject to the regulations of the most restrictive Abutting Transect Zone, except when
otherwise shown in the Parks and Public Spaces Master Plan; and
WHEREAS, the City Commission, from time to time, adopts master plans for City parks on
land zoned as CS and the City Commission wishes to ensure consistency with said adopted master
plans; and
WHEREAS, master planning efforts are inclusive of community input and reflect general
public consensus for certain projects; and
WHEREAS, ongoing efforts to improve areas zoned CS have created the need to include
other master plans adopted by the City Commission into the Miami 21 Code in order to be consistent
with other efforts and approvals by the City Commission; and
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on June 7,
2017, following an advertised public hearing, adopted Resolution No. PZAB-R-17-035 by a vote of
eleven to zero (11-0), item No. PZAB.2, recommending approval of the amendments to Ordinance
No. 13114 as set forth; and
WHEREAS, the City Commission, after careful consideration of this matter, deems it
advisable and in the best interest of the general welfare of the City and its citizens to amend the
Miami 21 Code as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE MIAMI CITY COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.

Section 2. The Miami 21 Code is hereby amended in the following particulars:1

5.7 CIVIC SPACE ZONES (CS) AND CIVIC INSTITUTION ZONES (CI)
5.7.1.4 In Civic Spaces, Buildings, Fences, and walls shall conform to regulations of the most
restrictive Abutting Transect Zone, except as shown by the City of Miami's Parks and Public
Spaces Master Plan or other master plans adopted by the City Commission. Other adjustments
to the regulations shall be approved by process of Exception.

Section 3. If any section, part of a section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. It is the intention of the City Commission that the provisions of this Ordinance
shall become and be made a part of the Miami 21 Code, which provisions may be renumbered
or relettered and that the word "ordinance" may be changed to "section", "article", or other
appropriate word to accomplish such intention.
Section 5. This Ordinance shall become effective immediately upon its adoption
and signature of the Mayor.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
