Good morning I
I was meaning to get back to you last night, as I was discussing this issue with Michael
yesterday evening and between one thing and the other I overlooked writing to you with
our available times to meet.
Michael will be out of town tomorrow and both of our schedules are jam packed with
meetings today.
We could either all meet on Friday at or after 4pm or I could make myself available
tomorrow afternoon between 3-5pm.
Please let me know what would work best for you and your clients.

Dear Luis:
As we discussed, below is a list of the terms that would be included as part of two separate settlement
agreements (please advise if this list is inclusive of all items that we discussed):
1) We will submit a joint letter of recommendation to the Zoning Commission
recommending the approval of the additional 3 townhomes on the basis that Developer has
listened and complied with security, aesthetic and construction concerns.
2) We will if necessary speak at Zoning Commission meeting where they will recommend
the approval of the additional 3 townhomes (or send letters of support in connection with any
Waiver or Exception required, to the extent that either are). Prepared remarks will state for the
record that Developer has been responsive to the security, aesthetic and construction concerns of
the neighborhood.
3) We will drop any and all prior opposition previously made to commission.
4) We shall voluntarily waive any rights to commence a cause of action against the
Developer for the development of that certain townhouse, whose legal description was not
included as part of the Major Use Special Permit approval.
5) We shall voluntarily waive any right to commence a cause of action against the
Developer for violations by the Developer regarding prior Settlement Agreement between the
Developer and the East Glencoe Neighborhood Association.

As we discussed. the consideration for purposes of construction impact mitigation is contemplated to be
$250k for my clients.
