HomeMy WebLinkAboutO-13692City of Miami Ordinance 13692 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 2228 Final Action Date: 6/22/2017 AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION FROM "T4-O", GENERAL URBAN TRANSECT-OPEN, TO "T5-O", URBAN CENTER TRANSECT-OPEN, FOR THE PROPERTY LOCATED AT 2950 NORTHWEST 7 AVENUE, MIAMI, FLORIDA; AND THE ZONING CLASSIFICATION FROM "T4-R", GENERAL URBAN TRANSECT ZONE -RESTRICTED, TO "T5-R", URBAN CENTER TRANSECT ZONE -RESTRICTED, FOR THE PROPERTIES LOCATED AT 720, 730, AND 744 NORTHWEST 30 STREET AND 735 NORTHWEST 29 TERRACE, MIAMI, FLORIDA, AS DESCRIBED IN "EXHIBIT A," ATTACHED AND INCORPORATED; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning, Zoning and Appeals Board ("PZAB"), at its meeting on April 19, 2017, following an advertised public hearing, adopted Resolution No. PZAB-R-17-028 by a vote of ten to one (10-1), Item No. PZAB.2, recommending approval of the requested Zoning Change; and WHEREAS, the proposed zoning change is in harmony with the established land use pattern in the adjacent and nearby districts; and WHEREAS, the proposed zoning change is in scale with the needs of the neighborhood or the City of Miami ("City"); and WHEREAS, the proposed zoning change will maintain the same or similar population density pattern and thereby does not increase or overtax the load on public facilities such as schools, utilities, streets, etcetera; and WHEREAS, the proposed zoning change will contribute to the improvement of development of properties in the adjacent area in accordance with existing regulations; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its inhabitants to grant this change of zoning classification as hereinafter set forth; and WHEREAS, the proposed zoning changes are consistent with the goals of the Miami 21 Code, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code") as the request is compatible with the surrounding zoning districts and provides an appropriate zoning transition; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 2228 (Revision:) Printed On: 3/21/2025 File ID: 2228 Enactment Number: 13692 Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Zoning Atlas of Ordinance No. 13114, as amended, is further amended by changing the zoning classification of approximately 1.02 acres (44,442 square feet) from "T4- 0," General Urban Transect Zone -Restricted, to "T5-O," Urban Center Transect Zone -Open, for the property located at 2950 Northwest 7 Avenue, Miami, Florida, and from "T4-R," General Urban Transect Zone -Restricted, to "T5-R," Urban Center Transect Zone -Restricted, for the properties located at 720 Northwest 30 Street, 730 Northwest 30 Street, 744 Northwest 30 Street, and 735 Northwest 29 Terrace, Miami, Florida, as described in "Exhibit A", attached and incorporated. Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Miami 21 Code, which provisions may be renumbered or re -lettered and that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. Section 5. This Ordinance shall become effective thirty-one (31) days after second reading and adoption thereof, pursuant and subject to Section 163.3187(5)(c), Florida Statutes.'
