(Primary) and Shasa Engineering, Corp. (Secondary), for court resurfacing at various City of Miami parks, on an as needed basis, for an initial contract period of three (3) years, with the option to renew for two (2) additional one (1) year periods; allocating funds from the various sources of funds from the end user department, subject to availability of funds and budgetary approval at time of need; further authorizing the City Manager to negotiate and execute all other documents, including any amendments, and modifications to said contract, in a form acceptable to the City Attorney, as may be necessary for said purpose. Background of Item: The City of Miami (City) has identified a need for court resurfacing at various City Parks. On February 13, 2017, the Department of Procurement (Procurement) issued IFB No. 681384 for court resurfacing at various City of Miami parks. As required by the Procurement Code, the IFB was advertised in three (3) newspapers of general circulation and issued on-line. On March 7, 2017, at the bid opening, two (2) bids were received. Procurement is recommending award to McCourt Construction Inc., as the primary contractor, and Shasa Engineering, Corp., as the secondary contractor, the two (2) responsive and responsible Bidders. The total estimated fiscal impact for the term of the contract, including option to renew years, is $1,500,000. (PRIMARY) AND SHASA ENGINEERING, CORP. (SECONDARY), THE TWO RESPONSIVE AND RESPONSIBLE BIDDERS, FOR COURT RESURFACING AT VARIOUS CITY OF MIAMI PARKS, ON AN AS NEEDED BASIS, FOR AN INITIAL CONTRACT PERIOD OF THREE (3) YEARS, WITH THE OPTION TO RENEW FOR TWO (2) ADDITIONAL ONE (1) YEAR PERIODS; ALLOCATING FUNDS FROM VARIOUS SOURCES OF FUNDS OF THE USER DEPARTMENT, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS AND MODIFICATIONS TO SAID CONTRACTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE. WHEREAS, the Department of Parks and Recreation has a need for court resurfacing at various City of Miami ("City") parks; and WHEREAS, the City issued Invitation for Bid ("IFB") No. 681384 to establish a contract for court resurfacing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The bids received March 7, 2017, pursuant to IFB No. 681384, from McCourt Construction, Inc. (Primary) and Shasa Engineering, Corp. (Secondary), the two (2) responsive and responsible bidders, for court resurfacing at various City parks, on an as needed basis, for an initial contract period of three (3) years, with the option to renew for two (2) additional one (1) year periods, are accepted. Section 3. Funds are to be allocated from the various sources of funds of the user department subject to the availability of funds and budgetary approval at the time of need. Section 4. The City Manager is authorized' to negotiate and execute all other documents, including amendments and modifications to said contract, in a form acceptable to the City Attorney, as may be necessary for said purpose. 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney including but not limited to those prescribed by applicable City Charter and City Code provisions. Section 5. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
