Purpose of Item:
A Resolution of the Miami City Commission authorizing the City Manager to execute an
Off -System Construction and Maintenance Agreement between the City of Miami and
the Florida Department of Transportation ("Department") for SR 9/ NW 27th Avenue at
the intersection with NW 17th Street, a road not on the State Highway System.
Background of Item:
The Florida Department of Transportation ("Department") has developed design plans
FM#436385-1-52-01, a roadway project along SR 9/ NW 27th Avenue at the
intersection with NW 17th Street ("Project"), within the City of Miami. The work within
the project limits shall include, but may not be limited to: an intersection safety
improvement project, which include median widenings, installation of a signal head and
backplates, signing, construction of a concrete island, relocation of drainage inlets, pull
boxes, and a bus stop, and retrofitting of existing lighting. The Project improvements on
NW 17th Street, a road not on the State Highway System, referred to as the "Local
Roadway Improvements", the following: median reconstruction and roadway for
approximately 200 feet to provide additional space for northbound to westbound left and
southbound to westbound right turning vehicles, milling, resurfacing, and restriping
pavement markings for approximately 400 feet west of the intersection with SR 9/NW 27
Avenue, approximately 100 feet of sidewalk replacement, installation and retrofitting of
lighting on NW 17th Street, installation of a new drainage inlet and modification of the
existing inlet to a manhole at the NW quadrant of the intersection. Both inlets will be
connected to the FDOT drainage system. The Project shall further include all activities
associated with, or arising out of the construction of the Local Roadway Improvement.
The Off -System Construction and Maintenance Agreement establishes the terms,
conditions and responsibilities of the Department and the City to accomplish the
improvements on the City's streets.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSTRUCTION AND
MAINTENANCE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH
THE FLORIDA DEPARTMENT OF TRANSPORTATION, FOR IMPROVEMENTS
ALONG STATE ROAD 9/NORTHWEST 27TH AVENUE AT THE INTERSECTION
WITH NORTHWEST 17TH STREET, A ROAD NOT ON THE STATE HIGHWAY
SYSTEM.
WHEREAS, the Florida Department of Transportation ("FDOT") has developed design
plans pursuant to Financial Management ("FM") No. 436385-1-52-01 for improvements along
State Road 9/Northwest 27th Avenue at the intersection with Northwest 17th Street ("Site") in the
City of Miami ("City"), a road which is not included on the State of Florida Highway System; and
WHEREAS, the project generally includes intersection safety improvement work
including median widenings, installation of a signal head and back plates, signing, construction
of a concrete island, relocation of drainage inlets, pull boxes, a bus stop, and retrofitting of
existing lighting ("Project"); and
WHEREAS, the improvements on Northwest 17th Street, a road not on the State
Highway System, include median reconstruction and roadway construction for approximately
two hundred feet (200') to provide additional space for northbound to westbound left turning
vehicles, and southbound to westbound right turning vehicles; milling; resurfacing; and restriping
pavement markings for approximately four hundred feet (400') west of the intersection with
State Road 9/Northwest 27t" Avenue; approximately one hundred feet (100') of sidewalk
replacement; installation and retrofitting of lighting on Northwest 17t" Street; installation of a new
drainage inlet; and modification of the existing inlet to a manhole at the Northwest quadrant of
the intersection ("Local Roadway Improvements"); and
WHEREAS, both inlets will be connected to the FDOT drainage system and shall further
include all activities associated with or arising out of the construction of the Local Roadway
Improvements; and
WHEREAS, the Construction and Maintenance Agreement ("Agreement") establishes
the terms, conditions, and responsibilities of FDOT and the City to accomplish the
improvements on the City's streets; and
WHEREAS, the City concurs with the proposed Project, the Local Roadway
Improvements to the Site, and overall upgrading and enhancement of the area; and
WHEREAS, the City agrees with the terms and conditions of the Agreement, in
substantially the attached form;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Agreement, in substantially
the attached form, with FDOT to accommodate the Improvements by FDOT to the Site.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
