City Clerk Voters first approved Flagstone "Island Gardens" project referendum, a response to a City RFP. ► December 2002 The City of Miami entered into its first agreement with Flagstone, the Agreement to Enter into a Ground Lease, often shortened to the "Agreement to Enter," which dictated the original terms upon which the City would lease part of Watson Island to Flagstone. ► September 2004 First Amendment to Agreement to Enter Submitted into the public record far ite (s) 5111 on 5 O Al P , City Clerk FLAGSTONE TIMELINE ► November 2006 Second Amendment to Agreement to Enter I. June 2008 Third Amendment to Agreement to Enter ► April 2010-June 2010 On the brink of expiration, the City granted Flagstone multiple extensions as negotiations were at a standstill. At this time, the City and Flagstone were also seeking a modification to a deed restriction from the State of Florida, for which the City was receiving some pushback. Eventually, the City and the State reached an agreement by which the State of Florida would take a 15% stake in part of the project. City Clerk FLAGSTONE TIMELINE ► September 2010 The City agreed to a Fourth Amendment to Agreement to Enter, which allowed Flagstone to develop the project on a "component by component" basis for the first time, dividing the project into three (3) components: (1) Marina Component; (2) Parking/Retail Component; and (3) Hotel Component. This amendment also adopted Composite Attachment 3, which provides for various construction deadlines and City termination rights. ► September 2011 The State of Florida and the City executed an agreement to modify the deed restriction which had originally prohibited conveyance of the land for private use/purposes. ► May 2014 Flagstone entered into Ground Lease with the City for Marina Component Submitted into the public n re qr on5136/I� City Clerk FLAGSTONE TIMELINE ► March 2016 A Temporary Use of Vacant Land Permit for pop up restaurant was approved by the City. ► September 2016 Temporary Use Permit expired on the 26th of September of last year. The restaurant continued to operate without a permit. October 2016 The City and Flagstone execute a Ground Lease for the parking/retail Component on October 11 ► January 2017 Flagstone received Notice of Violation from Code Compliance for operating a restaurant without a Certificate of Use and various health and safety violations. Submitted into the publiif record fqr ite (s) 1 t on 5 Ihb 11 , City Clerk FLAGSTONE TIMELINE ► March 2017 Flagstone was ordered by the State of Florida Department of Business and Professional Regulation (DPBR) to shut down the restaurant and was cited for 57 violations of health and food safety regulations ► April 2017 Flagstone was notified that they were delinquent on over $750,000 worth of property taxes, due no later that May 31, 2017. ► May 2017 Flagstone paid outstanding property taxes on May 22, 2017, just before the May 31 deadline.
