Subject: Execute - FDOT Airspace Agreement
Purpose of Item:
A Resolution of the Miami City Commission with attachments, authorizing the City
Manager to execute the State of Florida Department of Transportation ("FDOT"),
Airspace Agreement ("Agreement"), in substantially the attached form, providing for the
lease of FDOT-owned property known as FDOT Parcels 3831 and 4236, located
underneath Interstate 95, as more particularly described in Exhibit "A" of the Agreement
("Lease Area"), attached and incorporated, at no cost to the City of Miami ("City"), for an
initial term of ten (10) years with one (1) option to renew for an additional ten (10) years;
for the purpose of providing an urban search and rescue program training grounds and
secured parking, with terms and conditions more particularly described in the
Agreement.
Background of Item:
The Florida Department of Transportation ("FDOT") is the owner of the property known
as FDOT Parcels 3831 and 4236, located underneath Interstate 95, as more particularly
described in Exhibit "A" of the Agreement ("Lease Area").
FDOT desires to lease to the City of Miami ("City"), at no cost to the City, the Lease
Area, for an initial term of ten (10) years with one (1) option to renew for an additional
ten (10) years, for the purpose of providing an urban search and rescue program
training grounds and secured parking, with terms and conditions more particularly
described in the Agreement.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE THE STATE OF FLORIDA
DEPARTMENT OF TRANSPORTATION ("FDOT") AIRSPACE AGREEMENT
("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, PROVIDING FOR
THE LEASE OF FDOT-OWNED PROPERTY KNOWN AS FDOT PARCELS 3831 AND
4236, LOCATED UNDERNEATH INTERSTATE 95, AS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A" OF THE AGREEMENT ("LEASE AREA"), ATTACHED
AND INCORPORATED, AT NO COST TO THE CITY OF MIAMI, FOR AN INITIAL
TERM OF TEN (10) YEARS WITH ONE (1) OPTION TO RENEW TERM FOR AN
ADDITIONAL TEN (10) YEARS, FOR THE PURPOSE OF PROVIDING AN URBAN
SEARCH AND RESCUE PROGRAM TRAINING GROUNDS, AND SECURED
PARKING, WITH TERMS AND CONDITIONS MORE PARTICULARLY DESCRIBED IN
THE AGREEMENT.
WHEREAS, the Florida Department of Transportation ("FDOT") is the owner of the
property known as FDOT Parcels 3831 and 4236 ("Lease Area"), located underneath Interstate
95, as more particularly described in Exhibit "A" of the Airspace Agreement, attached and
incorporated ("Agreement"); and
WHEREAS, FDOT desires to lease to the City of Miami ("City"), at no cost to the City,
the Lease Area, for an initial term of ten (10) years with one (1) option to renew term for an
additional ten (10) years, for the purpose of providing an urban search and rescue program
training grounds, and secured parking, with terms and conditions more particularly described in
the Agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized' to execute the Agreement, in
substantially the attached form, between the City and FDOT, for the Lease Area at no cost to
the City, for an initial term of ten (10) years with one (1) option to renew term for an additional
ten (10) years, for the purpose of providing an urban search and rescue program training
grounds, and secured parking, with terms and conditions more particularly described in the
Agreement, attached and incorporated.
Section 3. This Resolution shall become effective immediately upon its adoption and

signature of the Mayor.2
APPROVED AS TO FORM AND CORRECTNESS:
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
