This rezoning application and supporting materials are submitted in request amend the transect zone designation for the Property from T6-8-0 to T6-12-0 (the "Application"). The Application will serve to achieve a transect zone for the Property that is compatible with the surrounding area and facilitates the redevelopment and use of the Property as contemplated by the Miami Comprehensive Neighborhood Plan ("MCNP") and consistent with the objectives of the Omni CRA, and promotes the continued revitalization and evolution of the area into a transit -oriented, walkable and liveable neighborhood. Through its principals - Damian Narvaez and Alex Karakhanian - the Applicant has extensive experience in revitalizing neighborhoods and activating underutilized properties and bringing life and activity to the surrounding area. They own properties in the MIMO Historic District, Allapattah, Wynwood, Design District, and Little River, and are passionate about investing in adaptive -reuse projects in historic and culturally rich neighborhoods and districts, having recently completed adaptive reuse projects on South Beach (Flamingo Park Historic District), in the MIMO Historic District, and involving existing industrial buildings in the Allapattah and Little River neighborhoods, as well as new construction in the Design District. They hope to bring their collective experience to the Omni seeing a great opportunity with this Property for multifamily and mixed use infill development around Biscayne Park to the south. I. Existing Conditions Based on the enclosed survey prepared by Royal Point Land Surveyors, Inc., dated, October 28, 2016, the Property has a total lot area of ±42,714 square feet (0.98 acres). The Property is located within the jurisdiction of the OMNI Community Redevelopment Agency ("CRA") {40435318;2} and within the OMNI Residential Density Increase Area (Art 4. Diagram 9), which allows residential density of 500 units per acre. The current zoning atlas identifies the Property's zoning designation as T6-8-0; the Future Land Use Map ("FLUM") identifies the Property's future land use as General Commercial. The southern portion of the Property is presently improved with a three-story pre -WWII commercial/light industrial building, initially constructed for use as an automotive storage and repair facility, and most recently used by Aspira Charter School. Because of the building's original purpose it does not lend itself well to integration with the surrounding neighborhood; the northern portion fronting on NE 20th Street contains a large surface parking lot. The Property is situated on an entire city block in a unique location to the north of Biscayne Park east of North Miami Avenue and the FEC rail line, in an interesting corner of the Omni neighborhood bordering Edgewater that is being revitalized around the existing Biscayne Park. • To the north across NE 20th Street is a parcel zoned D1 that is occupied by a Florida Power and Light ("FPL") electrical station. • To the south, the abutting parcel is zoned CI and is the site of Biscayne Park, and to the southwest an existing fire station. • To the east, abutting parcels along the south side of NE 20th Street are zoned T6- 12-0 and currently occupied by an existing auto repair facility; an additional abutting parcel to the southeast (1911 NE Miami Court) is zoned T6-8-0 and, as of the date of this letter, is under construction as the new multi -story Aspira Charter School. There are significant buffers created by transportation corridors and other features to the north and west, particularly to the west due to the FEC rail line and significant effective width of right of way created in conjunction with North Miami Avenue. II. Analysis under Miami 21, Article 7.1.2.8 While the existing zoning of the Property allows for a mix of residential uses by Right, the current zoning is particularly incompatible with development of a residential project at the density prescribed by the MCNP because of the restrictions on height and FLR. The proposed rezoning from T6-8-0 to T6-12-0 would allow a future project to achieve a unit count closer to the 500 units per acre permitted by the MNCP. This Application is consistent with the MCNP, Miami 21, and the OMNI CRA Redevelopment Plan, as described in greater detail below. a) Consistent with Miami Neighborhood Comprehensive Plan The MCNP and FLUM contained therein, reflect the City's vision, and its goals, objectives, and policies for directing long term planning and development within the City's neighborhoods. Pursuant to Chapter 163, Florida Statutes, the adoption of zoning regulations and zoning changes shall be consistent with the local government's comprehensive plan. For amendments to the Miami 21 Code such as rezonings, Article 7.1.2.8.f.1(a) of Miami 21 specifically requires consideration of "whether the proposed change will further the goals, objectives, and policies of the Comprehensive Plan; the Miami 21 Code; and other city regulations." {40435318;2} As set forth on the FLUM, the future land use designation of the Property is General Commercial, which allows residential density consistent with the High Density Multifamily Residential future land use area (150 units per acre). However, the Property also lies within the OMNI residential density increase area, as depicted on the Residential Density Increase Areas 2020 Future Land Use Map included as Appendix LU-1 to the MCNP, and is therefore specially designated as an area where a density of 500 units per acre is permitted. The General Commercial land use designation is consistent with the existing zoning of T6- 8-0, and remains consistent with the proposed transect zone of T6-12-0. The MCNP Correspondence Table - Zoning and Comprehensive Plan notes that the General Commercial future land use designation is intended for the urban core and is compatible with transect zones T6-8 through T6-48 (0 and L). Rezoning the Property from T6-8-0 to T6-12-0 is not only compatible with the future land use designation, but will actually facilitate greater consistency with the MCNP, as it will allow more of the permitted density to be realized on the Property, thus incentivizing the development of additional housing stock in the area and smaller unit sizes. A chart and massing diagram demonstrating anticipated development capacity are attached as Exhibit 1. Under the current zoning of T6-8-0, Miami 21 restricts the total Floor Lot Ratio ("FLR") and building height such that the number of units yielded from the permitted density of 500 units per acre would never fit into the building envelope on the Property. This would incentivize fewer larger more expensive units to be developed on the Property. The increase in permitted building height and FLR associated with rezoning to T6-12-0 would allow for development of a project that could practically achieve a total number of units much closer to the actual density of 500 units per acre intended by the MCNP, thereby resulting in a greater number of units and more flexibility in unit size and types as well as incorporation of ground floor retail and other amenities. b) Successional and Technical Rezoning Criteria are met The natural and organic growth and evolution of the City of Miami will demonstrate and necessitate from time to time that a change in zoning is appropriate. As set forth at Miami 21 Article 7, Section 7.1.2.8.a., changes to the boundaries of transect zones "shall occur successionally, in which the zoning change may be made only to a lesser Transect Zone; within the same Transect Zone to a greater or lesser intensity; or to the next higher Transect Zone, or through a Special Area Plan." As denoted in the table at 7.1.2.8.a.3., rezoning from T6-8-0 to T6- 12-0 is considered successional zoning. In addition to the successional zoning requirement, Miami 21 Article 7, Section 7.1.2.8.c.1, indicates that for a parcel of land to be considered for rezoning, it must contain a minimum of 40,000 square feet of land area or 200 feet of frontage on one street. But, if the rezoning is an extension of an existing transect zone, as is the case with this Application, neither the land area or frontage criteria is required. Nevertheless, the Property consists of ±42,714 square feet and has approximately 271 feet of frontage on NE Miami Court and would therefore meet both the minimum land area and frontage requirement even if we were not seeking an extension of an existing transect zone. The Application clearly meets all technical criteria for rezoning. In accordance with Miami 21 Article 7, Section 7.1.2.8.c.2.g., the Application is compatible with surrounding conditions and varying densities and intensities. The parcels located within a 1/2 mile radius consist of a variety of zoning districts and land uses and include the NRD-1 to the {40435318;2} northwest and north, urban core zoning transects (T6-8 and T6-36) associated with the Edgewater Neighborhood to the northeast and east, urban core transect zones (primarily T6-24) to the south of Biscayne Park and light industrial zoning districts transitioning to residential districts to the west. The most relevant existing land uses and zoning are within 300 feet of the Property and consist of a variety of commercial and civic uses that are compatible with the proposed rezoning of the Property. An aerial map and photo exhibit of parcels within 300 feet is attached as Exhibit 2. Importantly, the proposed T6-12 zoning would preserve a transition of no more than one transect with any abutting properties. And there are no lower density residential neighborhoods within the immediate area that would be negatively impacted by the Application. It is also important to note that under T6-12-0, there are no new or additional uses that will be permitted on the Property that are not already currently allowed by Right or through a special permit. The rezoning will, however, be more aligned with the MCNP in more closely aligning the zoning with the goals and objectives of the Future Land Use Element and specifically a high density residential project that contributes to the vitality of the neighborhood. c) Consistent with OMNI Community Redevelopment Area Goals and Objectives. The Property is located within the Omni CRA boundaries. The Omni CRA was created to address slum and blight through redevelopment and revitalization of dilapidated buildings. In the past year under the leadership of the Chair and Executive Director Jason Walker, the OMNI CRA has articulated a renewed focus and commitment to providing and supporting the creation of more housing options, and affordability to a range of income levels. By increasing the effective density achievable on the Property by a significant percentage and the Applicant's plans to demolish the existing structure and redevelop the Property, this Application is aligned and furthers the CRA goal of neighborhood revitalization and the CRA objective of providing a mix of much needed residential options. Specifically, Section 4.4.0 of the OMNI Area Community Redevelopment Area Plan (the "Redevelopment Plan") last amended January 21, 2010 identifies the objective to "Provide incentives for the development of a variety of housing choices, including affordable, special needs and workforce housing." The ultimate goal of the Applicant is to develop the Property as a multi -family residential project ("Project"), which is in line with the goals of the CRA. The proposed Application would be beneficial to the surrounding neighborhood and will allow for additional housing stock within the CRA. In order to develop a meaningful project that physically accommodates more of the permitted density and provide for an appropriate mix of unit types consistent with the Redevelopment Plan, the Property must be rezoned to T6-12-0. III. Future Redevelopment and Neighborhood Compatibility There is a demand and desire for small, reasonably -priced rental units in the area in which the Property is located, an area that is critical to the City of Miami and which has opportunity to leverage its civic and institutional resources and transportation accessibility to be one of the most walkable and accessible neighborhoods for young professionals and working families at a range of income levels. The Applicant envisions developing a multifamily residential project with ground floor retail where the residents will have convenient access to the great restaurants, art, and music venues in the surrounding bustling neighborhoods, the Arsht Center, and what will become entire Arts and Theater Districts. As the North Miami Avenue corridor continues to be revitalized, the {40435318;2} future residents of the Project will further the activation of that corridor and be able to utilize and increase ridership of the City's trolley system, service the new businesses that will emerge in the area as well as encourage the development of new commercial activity and continued restoration of derelict properties. The Applicant has the support of its immediate neighbor Aspira Charter School. See attached letter of support as Exhibit 3. We will continue to engage with our immediate neighbors as part of this Application and throughout the public hearing process. We will also continue to explore opportunities for collaboration with the city administration on improvements and linkages with the City's land to the south so that we can maximize the revitalization of the surrounding area.
