Since that time my experiences have included being an Assistant City Attorney for the Office of the City Attorney, City of Miami. Code enforcement, Red Light Camera, False Alarm and Value Adjustment Board cases are matters that I have covered as a Special Master/Special Magistrate for many years now. I have had the privilege of serving as Special Master for the City of Miami Gardens where I have learned the rules and regulations related to red light camera, code enforcement and false alarm cases and I have conducted the hearings by examining the code enforcement officer or police officer and the property owner's or vehicle registered owner and by weighing evidence, determining credibility and applying proper laws. Finally, I make a fair, unbiased, impartial decisions on the issue. Code Enforcement: These hearings are conducted to give the alleged violator the opportunity to contest the decision of the Code Enforcement Officer. The findings of fact are whether the alleged violation occurred and if so, whether the named person in the notice can be held responsible for that violation. If I find competent substantial evidence that the named violator was responsible, I then affirm the decision of the code inspector. The order is then rendered with the amount of the civil penalty, the administrative costs and the date by which the violation must be corrected. In addition to these hearings, I also hear Massey Hearings. These are hearings to determine whether there was due process/notice when they appealed the fine. Question: Did the City properly serve the person with notice of violation? If there was no procedural due process, I can hear new evidence. Otherwise, a hearing with respect to evidence was previously held or the owner/violator waived the right to that hearing by failing to appeal the fine. If there was due process, the City is entitled to confirmation of the fine. False Alarm: These cases are to determine whether the fines given to proper owners were properly imposed or if they should he overturned based on whether the officer responded to an emergency at the location or whether the alarm was a false alarm which has fines attached based on other evidence e.g. the number of times the alarms has sounded causing police response, whether the system is registered, etc. Red Light Camera: Under Florida Statute 316.0083 Mark Wandall Traffic Safety Program. As the special master, I explain that the City has authority in accordance with Section 316.008 and Section 316.0083 of the Florida Statutes to utilize traffic infraction cameras to regulate violations when a driver fails to stop at a traffic signal. 1 further explain the purpose of the hearing is to give the alleged violator the opportunity to be heard as they have filed an appeal related to the violation they received. As a part of this hearing I explain the five statutory defenses and the fine and administrative fee. There is other important information that I give and finally I make sure that all understand that they have the right to appeal my decision to the Circuit Court of Miami Dade County. I conduct the hearing by taking testimony and evidence from other sides including the alleged driver, as well as, the City (police office/City Attorney's Office) while keeping control over the proceedings. The decision is fair, unbiased and in line with the Florida Statutes and current case law. Either I uphold the violation or I dismiss the matter. Value Adjustment Board of Broward County: Special Magistrate. Property Appraiser and Tax Collector Cases- provides service as a hearing officer hearing matters in response to the petition filed by the property owner involving, but not limited to, classification, homestead exemption, substantial 3 completion, etc. Tasks involves hearing case, determining fact, research and applying appropriate law in rendering a decision to either uphold the property appraiser's denial or overturning their decision. Standard used is preponderance of the evidence. As a hearing officer, I can conduct hearings, call a hearing to order and move the hearing through the agenda covering special business and announcements, hear all cases on the agenda for that day, and provide a decision accordingly. Each experience that I have had over the years has required me to take testimony, examine witnesses, issue findings of fact based on the evidence presented (all made part of the record as appropriate) and provide conclusions of law. The orders I have given has rendered proper relief consistent with the powers given in my capacity as hearing officer. All my decisions have been issued timely. In preparation for hearings, I review all necessary materials including the agenda and ensure that I am current with the rules/laws that apply and there are no conflicts.
