Subject: Discussion - Unsolicited Proposal for Pavilion at Virginia Key Beach
Purpose of Item:
A Discussion Item to be heard by the Miami City Commission, with attachment(s),
reviewing the unsolicited proposal submitted by G and G Business Developments, LLC
for a Public -Private Partnership ("P3") to develop a Beach Pavilion in the southeast
sector of Historic Virginia Key Beach to be managed by the Virginia Key Beach Park
Trust ("Project"); further authorizing the City Manager to proceed with the unsolicited
proposal Project in accordance with Section 18-119, City of Miami Code of Ordinances,
subject to compliance with applicable laws and approval by the City Attorney as to legal
form.
Background of Item:
The City of Miami ("City") owns the waterfront property located in Virginia Key at 4010
and 4000 Virginia Beach Drive ("Property"). The Property is managed by the Virginia
Key Beach Park Trust. The City of Miami Department of Real Estate and Asset
Management has received an unsolicited proposal from G and G Business
Developments, LLC ("Developer") to develop a public beach pavilion on the Property.
The pavilion will hold two buildings including one building that will serve as event space
for approximately 100 people and another that will serve as a beach club available to
the public through a membership. The Project will respect the environment and
protected species. The proposed Project investment shall be approximately four million
dollars ($4,000,000). The proposed annual income to the City is one hundred and
twenty thousand ($120,000) for thirty (30) years. All agreements entered into in
connection with the proposed project shall comply with IRS rules and regulations related
to properties and facilities funded with tax-exempt bonds, and all terms and conditions
shall be subject to review by, and must be acceptable to, the City Attorney and the
City's Bond Counsel. Additionally, all agreements, terms, and conditions may also be
subject to continuing compliance related to historical grants and other funding
requirements. Finally, as per section 18-119 of the City of Miami Code of Ordinances,
the City shall first notify the commission of the unsolicited proposal by placement of a
discussion item on the agenda for the Commission's approval to proceed with said
unsolicited proposal project.
