HomeMy WebLinkAboutR-17-0194City of Miami Resolution R-17-0194 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 1993 Final Action Date: 4/27/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING, ATTACHED AND INCORPORATED AS ATTACHMENT "A", THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS, PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF FUNDS, IN THE AMOUNT OF ONE -HUNDRED NINETEEN THOUSAND SIX -HUNDRED THREE DOLLARS ($119,603.00) TO THE AGENCIES AS SPECIFIED IN ATTACHMENT "B", ATTACHED AND INCORPORATED, FOR ECONOMIC DEVELOPMENT ACTIVITIES; WITH FUNDS ALLOCATED FROM THE SOCIAL SERVICES GAP PROGRAM FUND; AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH SAID AGENCIES TO COMPLETE THE ALLOCATION. WHEREAS, on December 8, 2016, pursuant by Resolution No. 16-0605, the City of Miami ("City") Commission approved the changing of the fiscal year of the Department of Community and Economic Development ("CED") from April 1st through March 31st to October 1st through September 30th; and WHEREAS, on September 20, 2016, the City Commission approved a contribution from General Funds to CED which includes an amount of One -Hundred Nineteen Thousand Six - Hundred Three and 00/100 dollars ($119,603.00) for economic development activities to extend the current program year from twelve (12) months to eighteen (18) months; and WHEREAS, the City Manager has made a finding, attached and incorporated as Attachment "A", that pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), competitive negotiation methods and procedures are not practicable or advantageous to the City for obtaining said services, and has recommended to the City Commission that the finding, attached and incorporated as Attachment "A", be adopted and that competitive bidding methods and procedures be waived for the Program; and WHEREAS, the City Administration recommends the allocation of funds in the amount of One -Hundred Nineteen Thousand Six -Hundred Three and 00/100 dollars ($119,603.00) from the Social Services Gap Program Fund to the agencies specified in Attachment "B", attached and incorporated, for the extension of the fiscal year; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 1993 (Revision: B) Printed On: 3/20/2025 File ID: 1993 Enactment Number: R-17-0194 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manger's finding, attached and incorporated as attachment "A", that competitive negotiation methods and procedures are not practicable or advantageous to the City pursuant to Section 18-85(a) of the City Code, waiving the requirements for said procedures, is ratified, approved and confirmed. Section 3. The City Manager is authorized' to allocate grant funds in the total amount of One -Hundred Nineteen Thousand Six -Hundred Three and 00/100 dollars ($119,603.00) to the agencies specified in Attachment "B", attached and incorporated, for economic development activities, with said funds allocated from Social Services Gap Program Fund. Section 4. The City Manager is authorized' to execute agreement(s), in a form acceptable to the City Attorney, with said agencies for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity ttor ey ) 4/17/2017 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
