HomeMy WebLinkAboutResolutionCity of Miami Resolution Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 2060 Final Action Date: 4/27/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE TWO (2) TEMPORARY EVENT LIMITATION PER YEAR FOR PRIVATE PROPERTY PURSUANT TO SECTION 62-521(B)(4) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE") TO ALLOW LOUIS VUITTON USA, INC. TO HOLD FOUR (4) TWO (2) WEEK INDUSTRY RELATED EVENTS; FURTHER RELAXING THE HOUR OF OPERATIONS RESTRICTIONS CONTAINED IN SECTION 36-5(A) OF THE CITY CODE, ENTITLED "SAME —HOURS OF OPERATION OF JUKEBOXES, RADIOS, ETC.; EXEMPTION FOR EVENTS ON CITY -OWNED PROPERTY; RELAXATION," PURSUANT TO SECTION 36-5(C) OF THE CITY CODE FOR THE LOUIS VUITTON USA, INC. EVENTS LOCATED ON THE ROOFTOP AT 140 NORTHEAST 39 STREET, MIAMI, FLORIDA, BEGINNING MAY 1, 2017 AND ENDING APRIL 31, 2018. WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as amended ("City Code"), entitled "Planning and Zoning/Planning and Zoning Approval for Temporary Uses and Occupancies; Permit Required," temporary events are limited to no more than two (2) per year per property for a maximum of two (2) weeks per permit; and WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events can be waived upon affirmative vote of the City Commission; and WHEREAS, Section 36-5(a) of the City Code, entitled "Same —Hours of operation of jukeboxes, radios, etc.; exemption for events on city -owned property; relaxation", prohibits excessive noise or music on the premises between the hours of 11:00 p.m. and 7:00 a.m. the following day; and WHEREAS, Section 36-5(c) of the City Code provides that the City Commission may relax the time restriction set forth in Section 36-5(a) of the City Code by Resolution; and WHEREAS, Louis Vuitton USA, Inc. wishes to hold various industry related events at the property located at 140 Northwest 39 Street, Miami, Florida beginning May 1, 2017 and ending April 31, 2018 that will exceed the two (2) permit per year limitation; and WHEREAS, the proposed temporary event at the above location would be beneficial to the industry businesses in the City of Miami; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Pursuant to Section 62-521(b)(4) of the City Code, entitled "Planning and Zoning/Planning and Zoning Approval for Temporary Uses and Occupancies; Permit Required," the two (2) temporary event per property per year limitation is hereby waived to allow Louis Vuitton USA, Inc. to hold four (4) two (2) week events to be held on the rooftop of 140 Northeast 39 Street, Miami, Florida, beginning May 1, 2017 and ending April 31, 2018. Section 3. The time restriction contained in Section 36-5(a) of the City Code, entitled "Same —Hours of operation of jukeboxes, radios, etc.; exemption for events on city -owned property; relaxation" is hereby relaxed pursuant to Section 36-5(c) of the City Code for the Louis Vuitton USA, Inc. events to be held on the rooftop at 140 Northeast 39 Street, Miami, Florida beginning May 1, 2017 and ending April 31, 2018 pursuant to the temporary use and occupancy permit that must be obtained pursuant to Section 62-521 of the City Code. Section 4. This Resolution does not waive any other requirements of the City Code, including but not limited to, applicable fees, inspections, and permits. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'
