Miami Ave. Drainage Improvements Project Purpose of Item: Resolution authorizing the City Manager to terminate the Joint Participation Agreement between Miami -Dade County and the City of Miami for the construction of South Miami Avenue Drainage Improvements, Project B-30637A, that runs along South Miami Avenue from SW/SE 12 Street to SW/SE 10 Street, Miami, Florida. Background of Item: Miami -Dade County Department of Transportation and Public Works has a highway engineering project that will overlap with the City's proposed drainage improvements along South Miami Avenue. The County's project runs along South Miami Avenue from SW 8 Street to SE 15 Road, Miami, Florida; whereas the City's project runs along South Miami Avenue from SW/SE 12 Street to SW/SE 10 Street, Miami, Florida. As a result, it would not be constructive to continue the design and construction of two separate drainage improvements projects overlapping the same street segment. Furthermore, the drainage structures to be installed by the City would need to be replaced/relocated during the County's project to accommodate the proposed streets' new cross section. Nevertheless, the new drainage improvements proposed by the County will improve the City's flood control measures as originally intended in regard to the City's storm water pump station currently in construction under a separate project, Project B-30637, Mary Brickell Drainage Improvements. B-30637A, WHICH RUNS ALONG SOUTH MIAMI AVENUE FROM SOUTHWEST/SOUTHEAST 12 STREET TO SOUTHWEST/SOUTHEAST 10 STREET, MIAMI, FLORIDA; SUCH TERMINATION BEING EFFECTIVE IMMEDIATELY UPON SIGNATURE BY BOTH THE CITY AND THE COUNTY. WHEREAS, pursuant to Miami -Dade County ("County") Resolution No. 563-12 and City of Miami ("City") Resolution No. 12-0142, the parties hereto entered into a Joint Participation Agreement ("JPA") to facilitate the construction of South Miami Avenue Drainage Improvements, Project B-30637A ("Project"), which runs along South Miami Avenue, from Southwest/Southeast 12 Street to Southwest/Southeast 10 Street, Miami, Florida; and WHEREAS, the drainage improvements planned as part of the original Project will be included in the County's Department of Transportation and Public Works engineering project that runs along South Miami Avenue, from Southwest 8 Street to Southeast 15 Road, Miami, Florida; and WHEREAS, since the Project is no longer needed and such improvements will no longer be provided by the City, the County has drafted a resolution terminating the JPA, in substantially the attached form; and WHEREAS, such termination of the JPA shall be in its entirety and effective immediately upon execution by both the City and the County; and WHEREAS, the Project involved reimbursement funding to be provided to the City by the County, but since the Project has not occurred, no reimbursement or further action by either party, subsequent to signature, is necessary to terminate the JPA; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Section 3.
