HomeMy WebLinkAboutPre-LegislationCity of Miami Legislation Resolution: R-16-0393 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-01205 Final Action Date: 9/6/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE CITY OF MIAMI ("CITY") FISCAL YEAR 2016-17 MULTI -YEAR CAPITAL PLAN, AS REQUIRED PURSUANT TO THE COMMUNITY PLANNING ACT, SPECIFICALLY SECTION 163.3177, FLORIDA STATUTES (2016), AND PURSUANT TO CHAPTER 18/ARTICLE IX/DIVISIONS 1 AND 2 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "FINANCIAL/FINANCIAL POLICIES/ANTI-DEFICIENCY ACT/FINANCIAL INTEGRITY PRINCIPLES," TO SET FORTH THE CITY'S FISCAL NEEDS FOR CAPITAL IMPROVEMENTS, SUBJECT TO AN ANNUAL PLAN REVIEW, TO DETERMINE PROJECT PRIORITIES, TO ADD NEW CAPITAL PROJECTS, AND TO MODIFY FUNDING ALLOCATIONS AS NECESSARY. WHEREAS, a capital improvement programming process to support the Comprehensive Plan is required pursuant to the Community Planning Act ("Act"), specifically Section 163.3177, Florida Statutes (2016), and Chapter 18/Article IX/Divisions 1 and 2 of the Code of the City of Miami, Florida, as amended ("City Code"), entitled "Finance/Financial Policies/Anti-Deficiency Act/Financial Integrity Principles;" and WHEREAS, the City of Miami ("City") Fiscal Year 2016-17 Proposed Multi -Year Capital Plan ("Plan") incorporates the Fiscal Year 2015-16 Multi -Year Capital Plan set forth in Resolution No. 15-0394, adopted by the Miami City Commission on September 10, 2015, as subsequently amended by Resolution No. 15-0416 and Resolution No. 15-0424, both adopted September 24, 2015, Resolution No. 15-0463, adopted October 22, 2015, Resolution No. 15-0547, adopted December 10, 2015, Resolution No. 16-0021, adopted January 14, 2016, Resolution No. 16-0234, adopted May 12, 2016, and Resolution No. 16-02999, adopted June 23, 2016; and WHEREAS, a Capital Improvements Plan is a policy and management tool to plan municipal borrowing and indebtedness over a period of time, to establish annual expenditures within a framework of long-range fiscal requirements, and to serve as an official statement of the City's development plans; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City's Plan is approved, as required pursuant to Section 163.3177 of the Act and Chapter 18/Article IX/ Divisions 1 and 2 of the City Code, to set forth City fiscal needs for capital improvements, subject to an annual Plan review, to determine project priorities, add new capital projects, and modify funding allocations, as necessary. Section 3. The Plan, as posted on the City's website on July 7, 2016, is incorporated herein by City of Miami Page 1 of 2 File Id: 16-01205 (Version: 1) Printed On: 3/6/2017 File Number: 16-01205 Enactment Number: R-I6-0393 reference and may be amended to include al] of the applicable changes contained in the memorandum entitled "First Budget Hearing Changes Memo - FY 2016-17 Proposed Budget" - regarding the City's Operating and Capital Budgets along with any other subsequent changes. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10} calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
