HomeMy WebLinkAboutO-13674City of Miami Ordinance 13674 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 1131 Final Action Date: 3/23/2017 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY AMENDING ARTICLE 6, TABLE 13, ENTITLED "SUPPLEMENTAL REGULATIONS", TO ALLOW A DISTANCE SEPARATION REQUIREMENT FOR PUBLIC STORAGE FACILITIES; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 22, 2009, Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida was adopted ("Miami 21 Code"); and WHEREAS, demand for Public Storage Facilities has continued to increase due to the additional density in the Urban Core; and WHEREAS, Public Storage Facilities are generally designed with a lack of architectural diversity and inactive ground floors; and WHEREAS, although existing regulations allow for more architectural diversity, the lack of distancing requirements allows the close proximity of Public Storage Facilities which creates an adverse impact on the surrounding community; and WHEREAS, the design of a Public Storage Facility should be in a manner that is in keeping with the character and scale of the surrounding area; and WHEREAS, Public Storage Facilities should have ground floor retail along principal frontages with a minimum of fifty percent (50%) of the proposed ground floor retail use within the structure unrelated to the Public Storage Facility in order to promote activity on a site which would otherwise be inactive; and WHEREAS, it has been determined that modifications to the Miami 21 Code are required to allow a minimum distance of 2,500 feet between Public Storage Facilities and to activate the ground floor along principal frontages in an effort to preserve and respect various characteristics found throughout the City of Miami ("City") including neighborhoods and commercial corridors; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") at its meeting of February 15, 2017, following an advertised hearing, adopted Resolution No. PZAB-R-17-015 by a vote of nine -to -zero (9-0), recommending approval of this item; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its residents to amend the Miami 21 Code as hereinafter set forth; City of Miami Page 1 of 4 File ID: 1131 (Revision: A) Printed On: 3/20/2025 File ID: 1131 Enactment Number: 13674 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami 21 Code is hereby amended by making modifications to Article 6 in the following particulars:1 "ARTICLE 6. TABLE 13 SUPPLEMENTAL REGULATIONS D E N S T Y j U P A P U B L C S T 0 R A 0 E F A C L T Y T5 — URBAN CENTER ZONE RESTRICTED LIMITED OPEN 65 UNITS PER ACRE 65 UNITS PER ACRE 65 UNITS PER ACRE Allowed by Warrant and subject to the following additional requirements: Minimum distance requirement of 2,500 feet radius between proposed Public Storage Facility and another existing Public Storage Facility within any T5 or T6 Zone. Waiver for reduction in distance requirement is not permissible. Public Storage Facilities shall have ground floor retail along principal frontage. A minimum of 50% of the proposed ground floor retail shall be unrelated to the Public Storage Facility. Any Public Storage Facility that is legal nonconforming as to distance requirement shall not be permitted to expand or otherwise enlarge outside of its present Building footprint. The maximum size of any individual storage rental space shall be 400 square feet Controlled access and adequate security surveillance shall be provided throughout the Public Storage Facility. Any boat or vehicle stored in these facilities shall not exceed an overall length of 25 feet and shall be stored within a completely enclosed and ventilated Structure. Hours of operation shall be limited to 5:00 am to 11:00 pm. 1 Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. TABLE 13 SUPPLEMENTAL REGULATIONS DENSITY (UPA) PUBLIC STORAGE FACILITY T6 —URBAN CORE ZONE RESTRICTED LIMITED OPEN 150 UNITS PER ACRE * 150 UNITS PER ACRE ` 150-1,000 UNITS PER ACRE ` Allowed by Warrant and subject to the following additional requirements: Minimum distance requirement of 2,500 feet radius between proposed facility and another existing facility within any T5 or T6 Zone. Waiver for reduction in distance requirement is not permissible. Public Storage Facilities shall have ground floor retail along principal frontage. A minimum of 50% of the proposed ground floor retail shall be unrelated to the Public Storage Facility. Any Public Storage Facility that is legal nonconforming as to distance requirement shall not be permitted to expand outside of its present Building footprint. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Miami 21 Code, which provisions may be renumbered or relettered and that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. Section 5. This Ordinance shall become effective 30 days after final reading and adoption thereof.2 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
