HomeMy WebLinkAboutResolutionCity of Miami Resolution Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 1747 Final Action Date: 3/9/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING, ATTACHED AND INCORPORATED AS ATTACHMENT "A", THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS, PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF GRANT FUNDS FROM THE DISTRICT 1 SHARE OF THE CITY OF MIAMI'S ("CITY") ANTI -POVERTY INITIATIVE, IN A TOTAL AMOUNT NOT TO EXCEED $20,000.00, TO BARCELONA 1 CONDOMINIUM ASSOCIATION, INC. FOR THE INSTALLATION OF A SEPARATE WATER METER TO THE RESIDENTIAL PORTION OF THE BUILDING; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS NECESSARY, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Wifredo (Willy) Gort WHEREAS, on October 24, 2003, the Housing and Commercial Loan Committee ("HCLC") approved the allocation of $2,130,000.00 in HOME Program funds to Barcelona Condominiums, LLC ("BC") for construction of seventy-two (72) affordable homeownership units ("Project"); and WHEREAS, the City of Miami ("City") was informed by Barcelona 1 Condominium Association, Inc. ("HOA") that only one (1) meter connects the mixed -used building to the water main service, consequently, Miami -Dade Water and Sewer Department ("WASD") is charging all customers the commercial rate, resulting in a significantly higher sum billed to individuals residing within the residential part of the building; and WHEREAS, this situation is creating a financial burden on the low-income residents; and WHEREAS, the HOA has requested that a separate water meter be installed by WASD for the residential part of the building; and WHEREAS, since the majority of the residents are low income families, they are unable to afford the fees charged by WASD; and WHEREAS, it is the desire of the District 1 Commissioner to allocate $20,000.00 from the District 1 share of the Anti -Poverty Initiative to the HOA to assist the HOA with the connection of a second water meter for the residents; and WHEREAS, the City Manager is requesting authority to allocate grant funds from the City of Miami Page 1 of 2 File ID: 1747 (Revision:) Printed On: 1/17/2025 File ID: 1747 Enactment Number: District 1 share of the Anti -Poverty Initiative to the HOA for the installation a residential water meter; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The allocation of $20,000.00 from the District 1 share of the Anti -Poverty Initiative to the HOA, is authorized.' Section 3. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding, attached and incorporated as Attachment "A", that competitive negotiation methods and procedures are not practicable or advantageous, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended, and waiving the requirements for said procedures, is ratified, approved, and confirmed. Section 4. The City Manager is authorized' to execute the necessary documents, in a form acceptable to the City Attorney, to implement the allocation of said funds. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
