MMOA - Landscaping Purpose of Item: Requesting Department: Department of Resilience and Public Works Sponsored By: District Impacted: District 3, District 4 A Resolution of the Miami City Commission authorizing the City Manager to execute a Maintenance Memorandum of Agreement with the Florida Department of Transportation ("Department") for installation of landscaping and turf, within SR-90/SW 8th St from SW 27th Avenue to SW 3rd Avenue, Miami, FL. Background of Item: The Department has developed a pedestrian safety project along S.R. 90 (SW 8th Street), from SW 27th Avenue to SW 3rd Avenue. The project includes 10 mid -block crosswalks, upgrading pedestrian detectors, ramps to current standards, enhancing existing crosswalk markings, and providing sidewalk improvements at several locations. In addition, adding sidewalk along the south side of SW 8th Street between SW 4th Avenue and SW 3rd Avenue and additional lighting at mid -block crosswalks and signalized intersections. The installation of the landscaping and turf will enhance the aesthetics of the project. The City and Department currently have a Maintenance Agreement approved by Resolution No. 88-365 which will be supplemented by the subject MMOA. The additional areas will be folded into the maintenance schedule by the City's contractor. WHEREAS, the Florida Department of Transportation ("FDOT") has jurisdiction over State Road ("S.R.") 90/Southwest 8th Street from Southwest 27th Avenue to Southwest 3rd Avenue, Miami, Florida, which is located within the limits of the City of Miami ("City"); and WHEREAS, pursuant to Contract No. E-6K27, FDOT has drafted design plans for Safety Improvements ("Improvements") on S.R. 90/Southwest 8th Street from Southwest 27th Avenue to Southwest 3rd Avenue, Miami, Florida, the limits of which are described in Exhibit "A" ("Project Limits") of the Landscape and Turf Maintenance Memorandum of Agreement ("MMOA"); and WHEREAS, FDOT will install landscaping and turf in accordance with design plans for Contract No. E-6K27 ("Project"); and WHEREAS, the City and FDOT ("Parties") are currently operating under a Maintenance Agreement, pursuant to Resolution No. 88-365, adopted on April 14, 1988, which will be supplemented by the this MMOA; and WHEREAS, it is the intent of the Parties for the MMOA to supplement all maintenance requirements between the Parties for all previously executed Permits and Agreements; and WHEREAS, the Parties mutually recognize the need to enter into the MMOA designating and setting forth the responsibilities of the Parties with regards to the maintenance of all the landscaping and turf within the Project Limits; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to execute the MMOA, in substantially the attached form, with FDOT, to facilitate the installation of the Improvements within the Project Limits. 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney including but not limited to those prescribed by applicable City Charter and City Code provisions. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
