ING PROCEDURE
The City's growth and evolution over time will inevitably require changes to the boundaries of
certain Transect Zones. These changes shall occur successionally in which the rezoning may
be made only to a lesser Transect Zone; within the same Transect Zone to a greater or lesser
intensity; or to the next -higher Transect Zone; or through a Special Area Plan, as specified in
Article 7 of Miami 21.
Except where the request is for an extension of an existing Transect boundary, no rezoning of
land will be considered when the proposal is for a property is less than 40,000 square feet of
land area or 200 feet of street frontage on one street.
The public hearing process for a Rezoning will require appearing before the Planning, Zoning
and Appeals Board (PZAB) and the City Commission. Applications for Rezoning will be
considered by the City Commission two times per year. The dates are April and October.
Pre -Application Phase
1. Applicant may consult with the Zoning (4th Floor), Planning (3`d Floor) and Hearing Boards
(3rd Floor) for informal guidance at anytime.
2. The Planning and Zoning Department will schedule a date for the pre -application meeting
with representatives from the department to obtain information and guidance related to the
proposed application; the pre -application meeting shall take place no later than 15 days
prior to submittal of application.
3. At the pre -application meeting, staff will validate the survey prepared within six months from
date of application. The applicant will be provided with a zoning referral and application
materials.
Technical Review Phase
4. The Planning and Zoning Department will review the preliminary application and supporting
materials for completeness.

5. Applicant meets with the Hearing Boards to review application package prior to acceptance.

6. In order to be scheduled for the PZAB, the prospective applicant shall submit the application
and supporting documents for review and verification of completeness, and Hearing Boards

There is no deadline to submit this application as it is presented semi-annually to the Planning,
Zoning and Appeals Board and the City Commission. The application submittal date is the

be typed and signed in black ink. All pertinent and accurate information/documentation; i.e.,
the plans, reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt.

ORDINANCE NO. 11469, CODIFIED IN CHAPTER 2, ARTICLE VI OF THE CITY CODE
STATES THAT ANY PERSON WHO RECEIVES COMPENSATION, REMUNERATION OR
EXPENSES FOR CONDUCTING LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST
WITH THE CITY CLERK, PRIOR TO ENGAGING IN LOBBYING ACTIVITIES BEFORE CITY
STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. A COPY OF SAID
ORDINANCE IS AVAILABLE IN THE OFFICE OF THE CITY CLERK (MIAMI CITY HALL),

Letter of Intent
Dear Mr. Garcia,
Holland & Knight LLP represents, collectively, as co -applicants, the owners of the
properties located at 30 NW 34 St., 62 NW 34 St., 48 NW 34 St. and 54 NW 34 St. and 23 NW
33 Street, in connection with the land use and zoning change from "Duplex Residential" to "Low
Density Restricted Commercial" and from "T3-O" to "T4-O".
Both File No. 15-009731u (land use)15-00973zc (zoning change) were originally filed in
the July 2015 application cycle and included all the properties on NW 34 Street. The
application was considered by the Planning Zoning and Appeals Board on October 22, 2015 and
deferred by the City Commission to give the Planning staff the opportunity to study the area of
the application and the possibility of an area -wide comprehensive rezoning after outreach by the
applicants resulted in 20 petitions in support of rezoning the application properties as well as the
neighboring area. During this time, one of the applicants, Mr. Enriquez, sold his property to a
new owner, 33 Midtown, LLC who not only owns the abutting property fronting North Miami
Avenue which is already zoned T5, but also owns abutting property on NW 33 Street that is
currently zoned T3-O. The new owners and co -applicants, hereby request that the pending
application be amended to reflect the new owner and to include the additional parcel on 23 NW
33 Street. At their meeting of September 22, 2016, the City Commission remanded the
application to the Planning Zoning and Appeals Board with leave to include the additional
parcel.

Existing Conditions
The Application Property is comprised of five parcels. One of the parcels is developed as
a light industrial facility in operation since 1925; the three other parcels on NW 34 Street are
residential bungalows dating from 1928 to 1935. The new property is a vacant lot that has
served for surface parking to serve the businesses on N Miami Avenue.
The buildings and uses on the property at 30 NW 34 have been of a light industrial
nature since 1925. Specifically, the business has operated as a wood mill compatible with the
design and furniture manufacturing businesses in and around the Design District. Immediately
to the west, along the west side of the North Miami Avenue, the properties all have a T5-O
designation. These buildings are onwned by the new applicant, 33 Midtown, LLC. Prior to
Miami 21, this segment of the west side of North Miami Avenue was zoned "C-2" "Liberal
Commercial", an intense commercial district permitting heavy commercial uses. The current
and previous zoning of the North Miami Avenue Corridor recognize the existing and desired
commercial character of North Miami Avenue directly across the street from Midtown and the
proposed WalMart SuperStore. The blocks west of North Miami Avenue lack the transitional
buffer desired by the Miami 21 Code's transitional zoning philosophy.
Analysis for Requested LUP and Miami Zoning Amendments
The Owners/Co-Applicants seek a change from "T3-O" to "T4-O", consistent with the
successional zoning requirements of Section 7.1.2.8 of the Code as well as the companion land
use plan amendment from "Duplex Residential" to "Low Density Restricted Commercial." This
request will create an appropriate transition between the duplex residential ("T3-O") properties
to the west and the general commercial properties ("T5-O") to the east in Midtown and
Wynwood to the south. A similar request approved by the City Commission for properties on
NW 31 Street and NW 32 Street (See Files No. 15-000831u and 15-0083zc). The newly
included parcel on NW 33 Street will establish a full transition zone for the block and will create
and a coherent T4 Transect zone.
The requested "T4-O" transect, the General Urban Zone, is consistent with the existing
uses. The General Urban Zone consists of a Mixed -Use but primarily residential urban fabric
with a range of building types, including row houses, small apartment Buildings, and bungalow
courts. In addition, the requested zoning change is consistent with the goals and objectives of
the Miami 21 Code because it complies with the successional zoning requirements. The
introduction of a "T4-O" Transect zone between "T3-O" and "T5-O" provides a buffer between
the residential neighborhood to the west and the commercial uses to the east and is also
compatible with the established development patterns of uses in the immediate neighborhood.

and 54 NW 34 St. in Miami, I strongly support the request to rezone those
properties to T4 or T5.

also zoned 13. This area of Miami is surrounded by Midtown, the Design District
and Wynwood. This area needs revitalization and it is unrealistic to redevelop this

properties identified above and urge the members of the Planning, Zoning and
Appeals Board to support their request.
