HomeMy WebLinkAboutR-17-0067City of Miami Resolution R-17-0067 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 1437 Final Action Date: 2/9/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING, ATTACHED AND INCORPORATED AS ATTACHMENT "A", THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS, PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING AN ALLOCATION OF FUNDS TO THE AGENCIES SPECIFIED IN ATTACHMENT "B", ATTACHED AND INCORPORATED, IN THE TOTAL AMOUNT OF $416,426.50, FROM THE AIDS TO PRIVATE ORGANIZATIONS FUND, ACCOUNT NO. 00001.910101.882000, TO EXTEND THE CURRENT PROGRAM YEAR FROM TWELVE (12) TO EIGHTEEN (18) MONTHS; AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS NECESSARY TO COMPLETE SAID ALLOCATION, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, on September 20, 2016, through budgetary appropriation, the City Commission changed the fiscal year of the Department of Community and Economic Development ("Department") from April 1st through March 31 st to October 1st through September 30th; and WHEREAS, on September 20, 2016, the City Commission approved a contribution from General Funds to the Department from the Aids to Private Organizations Fund to assist public service activities and to extend the current program year from twelve (12) months to eighteen (18) months, thereby aligning the Department's program year to the City's fiscal year; and WHEREAS, the City Manager has made a finding, attached and incorporated as Attachment "A", that pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), competitive negotiation methods and procedures are not practicable or advantageous to the City for obtaining said services, and has recommended to the City Commission that the finding be adopted and that competitive bidding methods and procedures be waived for the Program; and WHEREAS, the City administration recommends the allocation of funds in the amount of $416,426.50 from the Aids to Private Organizations Fund to the agencies specified in Attachment "B", attached and incorporated, for the extension of the fiscal year; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding, attached and incorporated as Attachment "A", that competitive negotiation methods and procedures are not practicable or advantageous to the City pursuant to Section 18-85(a) of the City Code, waiving the requirements for said procedures, is ratified, approved and confirmed. Section 3. The City Manager is authorized' to allocate grant funds, in the total amount of $416,426.50, to the agencies as specified in Attachment "B", attached and incorporated, for Service activities is authorized, with said funds allocated from the Aids to Private Organizations Fund. Section 4. The City Manager is authorized' to execute any and all documents necessary to complete the transaction, in a form acceptable to the City Attorney, with said agencies for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity ttor ey ) 1/27/2017 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
