LOCATION: Approximately East of NE 4 Avenue, between NE 29 Street and NW 29 Terrace

APPLICANT(S): Jose Arango, Esquire, on behalf of AR Edgewater Investments LLC.
PURPOSE: This will allow the applicant to close, vacate, abandon and discontinue for public
use a portion of a public alley.
FINDING(S):
DEPARTMENT OF PLANNING AND ZONING: Recommended approval with conditions.
PLAT & STREET COMMITTEE: Recommended approval, with conditions, on December 3,
2015 by a vote of 6-0.
PLANNING, ZONING AND APPEALS BOARD: Recommended approval, with conditions on
November 2, 2016 by a vote of 9-0.

A RESOLUTION OF THE MIAMI CITY COMMISSION CLOSING, VACATING,
ABANDONING AND DISCONTINUING FOR PUBLIC USE A PORTION OF A PUBLIC
ALLEY LOCATED EAST OF NORTHEAST 4 AVENUE AND BETWEEN NORTHEAST
29 STREET AND NORTHEAST 29 TERRACE, MIAMI, FLORIDA, AS PROVIDED FOR
IN SECTION 55-15(C) OF THE CODE OF THE CITY OF MIAMI, FLORIDA.
WHEREAS, the Plat and Street Committee ("PSC"), at its meeting on December 3,
2015, reviewed the subject tentative plat entitled AR Edgewater Investments LLC ("Applicant")
and determined that all technical requirements, in addition to the criteria found in Section 55-
15(c) of the Code of the City of Miami, Florida, as amended ("City Code"), were met and by a
vote of six to zero (6-0) recommended approval, with condition(s), of the vacation and closure
as set forth herein; and
WHEREAS, the Department of Public Works and the Plat and Street Committee have
studied the subject vacation and closure and determined that it will not affect pedestrian or
vehicular traffic circulation or access for public service; and
WHEREAS, the Miami Planning, Zoning and Appeals Board ("PZAB") at its meeting on
November 2, 2016, following an advertised public hearing, adopted Resolution No. PZAB-R-16-
077 by a vote of nine to zero (9-0), item no. PZAB.8, recommending approval, with conditions,
of the vacation and closure as set forth herein; and
WHEREAS, the City Commission finds that it is in the best interest of the general welfare
of the City of Miami and its inhabitants to grant the vacation and closure of a portion of the
public Right -of -Way, as hereinafter described, and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The street/alley/easement located East of Northeast 4 Avenue between
Northeast 29 Street and Northeast 29 Terrace, Miami, Florida, as depicted in Exhibit "A", is
hereby closed, vacated, abandoned and discontinued for public use.
Section 3. The City Commission approves the vacation and closure subject to the
conditions established by the PZAB through Resolution No. PZAB-R-16-077, specifically that 1)
the Applicant, or its successor, shall comply with the conditions of approval for the AR
Edgewater Tentative Plat #1871 in a letter dated December 11, 2015 issued by the Department
of Public Works and that 2) the Applicant, or its successor, shall comply with all development
standards identified in the Miami 21 Code, the Zoning Ordinance of the City of Miami, Florida
and all applicable local, state and federal regulations.
Section 4. Approval of the requested vacation and closure shall be valid for a period of
four (4) years and shall remain independent of the referenced tentative plat during this period.
Section 5. The approved final plat must be recorded within the four (4) year approval
period of the requested vacation and closure.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
