A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO DRAFT AN ORDINANCE PROHIBITING THE CITY OF MIAMI FROM
JOINING AS CO -APPLICANT FOR ANY PRIVATE SPECIAL AREA PLAN
APPLICATION AND PROHIBITING LAND ZONED FOR CIVIC SPACE FROM
COUNTING TOWARDS THE GREATER THAN NINE (9) ABUTTING ACRE MINIMUM
REQUIREMENT FOR SPECIAL AREA PLANS.
WHEREAS, Section 3.9 of the Miami 21 Code, the Zoning Ordinance of the City of
Miami, Florida, as amended ("Miami 21 Code") allows for Special Area Plans ("SAP") for
"parcels greater than nine (9) Abutting acres in size to be master planned"; and
WHEREAS, the Miami 21 Code, particularly Section 7.1.4.3(a), contemplates that the
City of Miami ("City") may be an applicant in certain circumstances for various approvals; and
WHEREAS, in the past, the City has been a co -applicant with private parties for certain
SAPs; and
WHEREAS, the City Commission wishes to prohibit this practice; and
WHEREAS, to reach the "greater than nine (9) Abutting acre" minimum necessary to
apply for an SAP, some SAPs have included land zoned as Civic Space ("CS"); and
WHEREAS, the City Commission wishes to prohibit applicant's from including land
zoned as CS from counting towards the required minimum needed to apply for a private SAP;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is directed to draft and process an amendment to the
Miami 21 Code that would prohibit the City from applying as a co -applicant for any private SAP
application.
Section 3. The City Manager is further directed to draft and process an amendment to
the Miami 21 Code that would prohibit land zoned as CS from counting toward the "greater than
nine (9) Abutting acre" minimum necessary to apply for a private SAP.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
