A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED
PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S FINDING, ATTACHED AND INCORPORATED AS ATTACHMENT
"A", THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES
ARE NOT PRACTICABLE OR ADVANTAGEOUS, PURSUANT TO SECTION
18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED;
WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING
THE ALLOCATION OF GRANT FUNDS FROM THE DISTRICT 5 SHARE OF
THE CITY OF MIAMI'S ("CITY") ANTI -POVERTY INITIATIVE PROGRAM, IN A
TOTAL AMOUNT NOT TO EXCEED $195,000.00, TO FOUNDATION OF
COMMUNITY ASSISTANCE AND LEADERSHIP, INC. FOR THE FOREIGN
LANGUAGE, LEADERSHIP, AND COLLEGE EXPOSURE PROGRAM;
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY
AND ALL DOCUMENTS NECESSARY, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, FOR SAID PURPOSE.

WHEREAS, the City Manager is requesting authority to allocate grant funds from the City of
Miami ("City") District 5 Anti -Poverty Initiative Program to Foundation of Community Assistance
and Leadership, Inc. ("FOCAL") in a total amount not to exceed $195,000.00 for the Foreign
Language, Leadership, and College Exposure Program ("Program"); and
WHEREAS, the Program provides educational, vocational, and social services to individuals
and families of predominately low-income communities; and
WHEREAS, participants are students and the Program intends to develop self-confidence
and motivate the students to succeed academically; and
WHEREAS, the City Manager has made a finding, attached and incorporated as Attachment
"A", that pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended
("City Code"), competitive negotiation methods and procedures are not practicable or
advantageous to the City for obtaining said services, and has recommended to the City
Commission that the findings be adopted and that competitive bidding methods and procedures
be waived for the Program; and
WHEREAS, the City Manager is requesting authority from the City Commission to negotiate
and execute a grant agreement, in a form acceptable to the City Attorney, with FOCAL for said
Program;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the
City Manager's finding, attached and incorporated as Attachment "A", that competitive
negotiation methods and procedures are not practicable or advantageous to the City pursuant to
Section 18-85(a) of the Code of the City of Miami, Florida, as amended, and waiving the
requirements for said procedures, is ratified, approved and confirmed.
Section 3. The City Manager is authorized' to allocate grant funds from the District 5 share
of the City's Anti -Poverty Initiative Program, in a total amount not to exceed $195,000.00, to the
FOCAL for services to be provided by FOCAL.
Section 4. The City Manager is authorized' to negotiate and to execute a grant agreement,
in a form acceptable to the City Attorney, with FOCAL.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney including but not limited to those prescribed by applicable City Charter and City Code
provisions.
Z If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
