HomeMy WebLinkAboutR-17-0014City of Miami Resolution R-17-0014 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 1538 Final Action Date: 1/12/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING, ATTACHED AND INCORPORATED AS ATTACHMENT "A", THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS, PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF GRANT FUNDS FROM THE DISTRICT 5 SHARE OF THE CITY OF MIAMI'S ("CITY") ANTI -POVERTY INITIATIVE PROGRAM, IN A TOTAL AMOUNT NOT TO EXCEED $135,000.00, TO MARTIN LUTHER KING ECONOMIC DEVELOPMENT CORPORATION FOR THE WHEELS TO WORK PROGRAM; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS NECESSARY, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Keon Hardemon WHEREAS, the City Manager is requesting authority to allocate grant funds from the City of Miami ("City") District 5 Anti -Poverty Initiative Program to Martin Luther King Economic Development Corporation ("MLKEDC") in a total amount not to exceed $135,000.00 for the Wheels to Work Program; and WHEREAS, the Program will assist low-income individuals with their transportation needs to and from necessary activities such as work or educational institutions; and WHEREAS, participants will be from District 5 who have a transportation hardship; and WHEREAS, the City Manager has made a finding, attached and incorporated as Attachment "A", that pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), competitive negotiation methods and procedures are not practicable or advantageous to the City for obtaining said services, and has recommended to the City Commission that the finding be adopted and that competitive bidding methods and procedures be waived for the Program; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute, in a form acceptable to the City Attorney, a grant agreement with MLKEDC, for said Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 1538 (Revision:) Printed On: 3/18/2025 File ID: 1538 Enactment Number: R-17-0014 Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding, attached and incorporated as Attachment "A", that competitive negotiation methods and procedures are not practicable or advantageous to the City pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended, and waiving the requirements for said procedures, is ratified, approved and confirmed. Section 3. The City Manager is authorized' to allocate grant funds from the District 5 share of the City's Anti -Poverty Initiative Program, in a total amount not to exceed $135,000.00, to MLKEDC for the Wheels to Work Program. Section 4. The City Manager is authorized' to negotiate and to execute a Grant Agreement with MLKEDC, in a form acceptable to the City Attorney. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: -- "r( ez, City ttor ey 12/23/2016 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
