authorizing funding, in the amount of $172,486.24 for the Miami -Dade County
Association of Chiefs of Police, Court Overtime Reduction Project. Funding is to be

Background of Item:
In an effort to contain rising overtime costs, the Miami -Dade County Association of
Chiefs of Police, along with the State Attorney's Office, instituted the "Miami -Dade
County Court Standby Program." This program has dramatically reduced court
overtime costs for all law enforcement agencies. Since the program's implementation in
1997, our department has reduced overtime costs by 60%, from $2,077,958.00 (FY `97)
to approximately $833,464.00 (FY 2015-16).
The system uses administrative support personnel to ascertain officer, as well as victim
and witness, availability, allowing the State Attorney's Office to plan accordingly.
Officers are notified of being placed on a "standby" basis and will only be called when
needed. All police departments in Miami -Dade County are required to continue to
financially support this court overtime reduction program. Funds from participating law
enforcement agencies are used to hire administrative support personnel necessary to
implement the Miami -Dade County Court Standby Program. Law enforcement agencies
are now billed based on the proportional utilization of the services from the participating
law enforcement agencies as defined by the number of misdemeanor, traffic (including
driving under the influence) and domestic violence court cases processed through the
Richard E. Gerstein Justice Building (Miami -Dade County Courthouse) located at 1351
NW 12th Street.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE
ALLOCATION OF FUNDS, IN AN AMOUNT NOT TO EXCEED $172,486.24, FOR A
ONE (1) YEAR PERIOD, TO THE MIAMI-DADE COUNTY ASSOCIATION OF CHIEFS
OF POLICE, COUNTY COURT STANDBY PROGRAM; ALLOCATING FUNDS FROM
THE DEPARTMENT OF POLICE GENERAL OPERATING BUDGET, ACCOUNT NO.
00001.191501.534000.0000.00000.
WHEREAS, the City of Miami Police Department ("MPD"), like other police departments
in Miami -Dade County, is facing increases in court overtime costs; and
WHEREAS, the Miami -Dade County Association of Chiefs of Police ("Association") and
the Miami -Dade County State Attorney's Office ("SAO") have implemented the County Court
Standby Program ("Program") which employs administrative support personnel to notify crime
victims, witnesses and officers when they are required to appear in criminal court, thereby
reducing the number of times an officer makes a court appearance to find either the victim or
the witnesses are absent and/or the proceeding is continued; and
WHEREAS, since implementation of the Program, this system has greatly reduced the
costs of overtime for court appearances for all local law enforcement agencies, including MPD;
and
WHEREAS, the agency members of the Association are billed based on the proportional
utilization of the services from the participating law enforcement agencies, as determined by the
number of misdemeanor cases processed through the Richard E. Gerstein Justice Building,
located at 1351 Northwest 12th Street, Miami, Florida, as well as the misdemeanor domestic
crimes cases processed at the Lawson E. Thomas Courthouse Center, located at 175
Northwest 1st Avenue, Miami, Florida; and
WHEREAS, MPD's proportional share of expenses for its inclusion in the Program is
$172,486.24; and
WHEREAS, the funding will assist the Association and the SAO with expenses related to
the employment of administrative support personnel necessary for the operation of the Program;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The allocation of funds, in an amount not to exceed $172,486.24, for a one (1)
year period, for MPD's participation in the Program is authorized.'
Section 3. Funds to be allocated from the Police General Operating Budget, Account No.
00001.191501.534000.0000.00000.
Section 4. This Resolution shall become effective immediately upon adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
