Alfo soREFERENCES: Resolution R-15-0421 (File ID 15-01185) City Manager ENCLOSURES: Location Maps & Resolution R-15-0421 Pursuant to Resolution R-15-0421, adopted on September 24,2015, the Miami City Commission authorized the City Manager to negotiate a grant or purchase and sale agreement with the Florida East Coast Railway ("FEC") for the acquisition of a portion of a former railroad right of way to assist in the creation of the proposed Ludlam Trail. The resolution further directed the City Manager to provide a status report. In furtherance of Resolution R-15-0421, below please find a status report of the potential land acquisition: ➢ The City is awaiting receipt of two appraisal reports currently being procured by Miami -Dade County ("County") in order to obtain market value for the proposed acquisition of the Ludlam Trail that falls within the City of Miami ("City") located between West Flagler Street and Southwest 8th Street. The County has yet to receive said appraisals. Aerial images of the FEC railroad right of way and the portion of the right of way within the City are attached hereto for your convenience. ➢ After receiving a copy of the appraisal reports from the County, the Department of Real Estate and Asset Management ("DREAM") will conduct an appraisal review to determine whether the City will need to procure its own independent appraisal report. ➢ DREAM obtained a list of comparable properties from CBRE reflecting recent market sales ranging from $608,000 to $1,300,000 per acre. ➢ DREAM has begun preliminary negotiations with the FEC in order to acquire the subject properties. ➢ DREAM will further obtain an appraisal for market value of 7001 SW 4 ST that is owned by the Miami -Dade County School Board containing approximately 11.87 acres and located adjacent to the proposed Ludlam Trail. ➢ DREAM identified a property currently available for sale located at 6950 NW 7 ST residing just outside of the City limits, abutting the CSX Line which lies adjacent to Robert King High Park. This Property is listed at $4,000,000.00 and has been available since 09/09/2015. Preliminary research of public records indicated that this property is encumbered by burdensome restrictive covenants running with the land that may significantly impact land use and value of the property. ➢ DREAM is actively searching for properties adjacent to the Ludlam Trail that may become available for sale for a potential assemblage and/or to increase the number of access points to the proposed linear park. ➢ Any real estate purchase is subject to a Phase I Environmental Site Assessment. EEC Corridor 1/11/2016 City of Miami Legislation Resolution: R-15-0421 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-01185 Final Action Date: 9/24/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, AUTHORIZING THE CITY MANAGER TO NEGOTIATE A GRANT OR PURCHASE AND SALE AGREEMENT WITH THE FLORIDA EAST COAST RAILWAY COMPANY FOR THE ACQUISITION OF THAT PORTION OF THE FORMER RAILROAD RIGHT OF WAY BETWEEN WEST FLAGLER STREET AND SOUTHWEST 8TH STREET LYING BETWEEN SOUTHWEST 69TH AVENUE AND SOUTHWEST 70TH AVENUE, MIAMI, FLORIDA, AT AN INITIAL CONTRIBUTION AMOUNT NOT TO EXCEED ONE MILLION DOLLARS ($1,000,000.00) TO ASSIST IN THE CREATION OF THE PROPOSED LUDLAM TRAIL; FURTHER DIRECTING THE CITY MANAGER TO PRESENTA STATUS REPORT OF THE SAME, OR AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS APPLICABLE, TO THE CITY COMMISSION WITHIN NINETY (90) DAYS OF THIS RESOLUTION. WHEREAS, Florida East Coast Railway Company ("FEC") owns the unused railroad right -of way that runs from Miami International Airport to the Dadeland Mall between Southwest 69th Avenue and Southwest 70th Avenue, Miami, Florida; and WHEREAS, FEC is currently seeking development approval for that portion of the right-of-way located within unincorporated Miami -Dade County ("County"); and WHEREAS, it is substantially likely that any development approval will allow for the right-of-way to continue in some fashion as an uninterrupted multi -use trail; and WHEREAS, the portion between West Flagler Street and Southwest 8th Street is wholly within the City of Miami ("City") and acquisition thereof would allow for the creation and extension of a multi -use urban trail; and WHEREAS, the County has issued a request for quotes for an appraisal of certain portions of this corridor in connection with an application for development by FEC; and WHEREAS, the City has a unique opportunity to coordinate with the County and FEC to create a unique linear park; and WHEREAS, the City wishes to explore a multi -year commitment with FEC for said purposes; and WHEREAS, said trail would add to the City's parkland and benefit the surrounding neighborhood; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is authorized {1} to negotiate a grant agreement or purchase and sale agreement, in a form acceptable to the City Attorney, with FEC, at an initial contribution not to exceed one million dollars ($1,000,000.00) for the purpose of acquiring the portion of the FEC right -of way between West Flagler Street and Southwest 8th Street and Southwest 69th Avenue and Southwest 70th Avenue, Miami, Florida. Section 3. The City Manager is further authorized{1}, after consultation with the City Attorney, to draft all other necessary document(s) for said purpose and to bring those documents back to the City Commission for approval within ninety (90) days or, if negotiations are ongoing or have concluded unfavorably, to give the City Commission a status report within ninety (90) days. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
