Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute an Interlocal Parking Agreement, in substantially the attached form,
with the Department of Off -Street Parking (DOSP) to manage parking fee collections at
Virginia Key Beach North Pointe Park and boat ramp fee collections at Antonio Maceo
Park, Curtis Park, Legion Park, and Morningside Park, properties owned and operated
by the City where the City is currently collecting fees, for a period of five (5) years, with
an option to extend for one (1) additional period of five years, for a total term that shall
not exceed ten (10) years; further providing that either party shall have the right to
terminate said agreement at any time upon providing prior written notice to the other
party.
Background of Item:
The City owns certain real property at Virginia Key Beach North Pointe Park and other
real property consisting of public boat ramps at Antonio Maceo Park, Curtis Park,
Legion Park, and Morningside Park, and corresponding Parking Facilities for each. The
Parks and Recreation Department and DOSP wish to enter into an agreement that will
allow the DOSP to manage the parking fee and boat ramp revenue collections at said
parks. The City will benefit from the DOSP managing the Parking Facilities at the parks
by allowing patrons to visit each of these parks under a managed parking system, while
enhancing the parking experience for those patrons.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL
MANAGEMENT AGREEMENT("AGREEMENT"), IN SUBSTANTIALLY THE
ATTACHED FORM, WITH THE DEPARTMENT OF OFF-STREET PARKING A/K/A
MIAMI PARKING AUTHORITY ("MPA"), AN AGENCY AND INSTRUMENTALITY OF
THE CITY OF MIAMI ("CITY"), FOR THE MANAGEMENT AND OPERATION OF THE
PARKING FACILITIES SERVICING CITY -OWNED AND OPERATED PARKS, FOR A
PERIOD OF FIVE (5) YEARS, WITH AN OPTION TO EXTEND FOR ONE (1)
ADDITIONAL PERIOD OF FIVE (5) YEARS, FOR A TOTAL TERM THAT SHALL NOT
EXCEED TEN (10) YEARS, WITH THE SAME TERMS AND CONDITIONS AS SET
FORTH IN SAID AGREEMENT; FURTHER PROVIDING THAT EITHER PARTY
SHALL HAVE THE RIGHT TO TERMINATE SAID AGREEMENT AT ANY TIME UPON
PROVIDING NO LESS THAN ONE HUNDRED TWENTY (120) DAYS PRIOR
WRITTEN NOTIFICATION OF TERMINATION.
WHEREAS, the City of Miami ("City") owns certain real property at Virginia Key Beach
North Pointe Park and real property consisting of public boat ramps at Antonio Maceo Park,
Curtis Park, Legion Park and Morningside Park ("Parks"), and the corresponding parking facility
for each ("Parking Facilities"); and
WHEREAS, the City and the Department of Off -Street Parking of the City, referred to as
the Miami Parking Authority ("MPA"), wish to enter into an agreement that will allow the MPA to
manage the Parking Facilities at the Parks; and
WHEREAS, the City and the MPA desire to enter into an Interlocal Management
Agreement ("Agreement"), in substantially the attached form, providing that the MPA has
the authority, knowledge, and familiarity to conduct such business; and providing that the MPA
has the reputation and experience to undertake and provide the oversight, collection of fees and
enforcement for the Parking Facilities at these sites; and
WHEREAS, the Agreement is for an initial period of five (5) years and the City, at its sole
and exclusive option, may extend the term of this Agreement for one (1) additional period of five
(5) years, for a total term that shall not exceed ten (10) years, with the same terms and
conditions as set forth in said Agreement; and
WHEREAS, either party shall have the right to terminate said Agreement at any time
upon providing no less than one hundred twenty (120) days prior written notification of
termination;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute an Agreement, in substantially
the attached form, with the MPA for the management and operation of the Parking Facilities at
the Parks for a period of five (5) years, with an option to extend for one (1) additional period of
five (5) years, for a total term that shall not exceed ten (10) years, with the same terms and
conditions as set forth in said Agreement.
Section 3. It is further provided that either party shall have the right to terminate the
Agreement at any time upon providing advance written notice to the other party of no less than
one hundred twenty (120) days.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature by the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this resolution, it shall become effective
immediately upon override of the veto by the City of Miami Commission.
