Address: 333 SE 2'd Avenue Miami, Florida 33131 Page 1 of 5 The undersigned, in consideration of the payment of $1.00 and other good and valuable consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to Florida Power & Light Company, its licensees, agents, successors, and assigns (" F'PL"), a non-exclusive easement forever for the construction, operation and maintenance of overhead and underground electric utility facilities (including wires, poles, guys, cables, conduits and appurtenant equipment) to be Installed from time to time; with the right to reconstruct, improve, add to, enlarge, change the voltage, as well as, the size of and remove such facilities or any of them within an easement five (5) feet in width described as follows: Reserved for Recordin SEE EXHIBIT "A" ATTACHED HERETO AND INCORPORATED HEREIN BY THIS REFERENCE Together with the rightto permit FPL to attach wires to any facilities hereunder and lay cable and conduit within the easement in connection with the operation and maintenance of electric utility facilities; the right of ingress and egress to said premises at all times; the right to clear the land and keep it cleared of all trees, undergrowth and other obstructions within the easement area; to trim and cut and keep trimmed and cut all dead, weak, leaning or dangerous trees or limbs outside of the easement area which might interfere with or fall upon the lines or systems of communications or power transmission or distribution; and further grants, to the fullest extent the undersigned has the power to grant, if at all, the rights hereinabove granted on the land heretofore described, over, along, under and across the roads, streets or highways adjoining or through said property. The undersigned reserves all other rights in and to the easement area not inconsistent with the easement grant contained herein, including the right to grant other easements across all or any portion of the easement area, provided the same do not unreasonably interfere with the use of the easement area by Florida Power & Light Company. The parties acknowledge that by entering into this agreement for an easement, the City shall not waive and, in all respects, reserves any and all rights it may have to enforce and otherwise compel the terms and conditions of the agreement the City executed with FPL during the proceedings concerning the licensing of FPL's nuclear reactors No. 6 and No. 7 at Turkey Point and that FPL shall not commence construction on any part of the associated transmission lines and/or facilities until and unless FPL obtains the required permits and licenses to construct said reactors. Should the EASEMENT be abandoned or discontinued by law or otherwise, or no longer of use for the purposes provided herein or if FPL, its licensees, agents, successors, and assigns do not comply with any term, covenant or condition of this instrument, the said EASEMENT shall cease and revert automatically and require no further action on the part of the City, with the right of immediate possession and right of entry to the undersigned or its successors in interest.
