Please allow this letter to serve as the required letter of intent in connection with a request for rezoning of the Property. Description of Property. The Property is located on the south side of SW 7 Street between SW 7 Avenue and SW 7 Avenue. Miami -Dade County's Office of the Property Appraiser identifies the Property through Miami -Dade Tax Folio Nos. 01-0204-060-1030, 01-0204-060-1040, 01-0204-060-1050. The Property is approximately 22,500 square feet (0.52 acres) in size. The Property contains two-story multi family structures in various states of disrepair. See Figure 1. Property Zoning. Figure 1. The Property is not historically designated, nor within a historic district. Further, the Property is not located within an archeological conservation area. Rezoning Request. The Applicant seeks a rezoning of the Property from T5-L to T5-O in order to create a cohesive assemblage for future development. The Applicant is requesting a rezoning that is less intense than the existing development pattern in this area. The "0" (Open) designation is necessary to accommodate a proper transition to the zoning to the south. Further, as Figure 1. shows, there are several segments of T6-8-0 zoning within a half mile radius of the Property which extend from SW 8 Street north to SW 7 Street. Instead of requesting the more intense, adjacent T6-8-0 zoning transect, the Applicant respectfully requests the less intense, T5-O, transect. It should be noted that the parcels immediately to the east of the Property, were rezoned from T5-L to T5-O (Legislative File ID No. 16-00054zc) in May 2016. The requested rezoning is an extension of the approved T5-0 zoning of the property to the east of the Property. Criteria. Section 7.1.2.8(f) of Miami 21 provides the criteria for amendments to Miami 21. The provision provides as follows "[f]or all amendments: (a) The relationship of the proposed amendment to the goals, objectives and policies of the Comprehensive Plan, with appropriate consideration as to whether the proposed change will further the goals, objectives and policies of the Comprehensive Plan; the Miami 21 Code; and other city regulations. (b) The need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary." The proposed amendment is consistent with the goals, objectives and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"). For instance, Objective LU-1.3 states as follows: The City will continue to encourage commercial, office and industrial development within existing commercial, office and industrial areas; increase the utilization and enhance the physical character and appearance of existing buildings; encourage the development of well -designed, mixed -use neighborhoods that provide for a variety of uses within a walkable area in accordance with neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives; and concentrate new commercial and industrial activity in areas where the capacity of existing BERCOW RADELL & FERNAN DEZ Ca NI N4. The Property is located within an area designated on the FLUM as Medium Density Restricted Commercial. The Applicant requests a rezoning from the T5-L transect zone to T5-O in order to enhance the commercial character, create a cohesive assemblage, and accommodate a more appropriate transition to the more intense use of the Property along SW 8 Street. Approval of this application will encourage commercial development in a mixed use, walkable area where existing public facilities, including high frequency bus routes, meet or exceed the minimum standards. Further, approval of this application would encourage a development pattern, in line with the existing context, that would enhance the existing neighborhood by continuing to develop a balanced mix of uses and employment opportunities. A zone "change may be made only to the next intensity Transect Zone or by a Special Area Plan, and in a manner which maintains the goals of this Miami 21 Code to preserve Neighborhoods and to provide transitions in intensity and Building Height." See Section 7.1.2.8(f)(2), Miami 21. The Applicant requests a change from T5-L to T5-O, which is a request in the same category of transect zone, not in a higher intensity transect zone. Approval of the Applicant's request will allow for enhanced utilization of the Property within the T5 transect zone, not for increased intensity. Therefore, the Applicant's request maintains the goals of Miami 21 to preserve neighborhoods and continue providing for transitions in intensity. Conclusion. The properties to the east are zoned T5-O and T6-8-O. The properties to the south of the Property are zoned T6-8-O. The future land use designation of the properties to the east and west of the Property are a mix of Medium Density Restricted Commercial and Restricted Commercial. The land use designation of the properties to the north and south is a combination of Restricted Commercial and Medium Density Restricted Commercial, along SW 7 Street and SW 8 Street and lower density/intensity categories, including Medium Density Multifamily Residential, Low Density Restricted Commercial, and Low Density Multifamily Residential moving away from SW 7 Street and SW 8 Street. The land use designations are reflective of the fact that SW 7 Street and SW 8 Street are major east -west thoroughfares within the City. It should be noted that the zoning of the properties does not completely reflect the prominence of the SW 7 Street corridor within this area. Should this Declaration of Restrictions be modified, released or terminated, the City shall forthwith execute a written instrument effectuating and acknowledging such modification, amendment or release. 6. In the event of any breach of this Declaration, enforcement may be by action at law or in equity, against any parties or persons violating or attempting to violate any covenants herein, either to restrain violations or recover damages. The parties agree that a breach of this Declaration shall create the presumption of irreparable harm for the purposes of any injunctive relief. The prevailing party in action or suit pertaining to or arising out of this Declaration shall be entitled to recover, in addition to any other remedies available at law, in equity or both. 7. In the event the terms of this Declaration are not being complied with, in addition to any other remedies available, the City is hereby authorized to withhold any further permits from and refuse to make any inspections or grant any approvals to, the Properties until such time as there is compliance with this Declaration. 8. All rights, remedies, and privileges granted herein shall be deemed to be cumulative and the exercise of any one or more shall neither be deemed to constitute an election of remedies, nor shall it preclude the party exercising the same from exercising such other additional rights, remedies, or privileges. 9. Where construction has occurred on any portion of the Properties, pursuant to a lawful permit issued by the City, and inspections made and approval of occupancy given by the City, then such construction, inspection, and approval shall create a rebuttable presumption that the structures thus constructed comply with the intent and spirit of this Declaration. 10. Invalidation of any of the covenants contained herein shall not affect any other provisions, which shall remain in full force and effect. 11. This Declaration of Restrictions may be modified, released or terminated as to the land herein described, or any portion thereof, by written instrument executed by the then - owners of all the Properties, including joinders of all mortgagees, if any, provided that the same is also approved by the Development Services Director, following necessary and appropriate inspections, which demonstrate that the properties fully comply with the Building and Zoning Codes of the City, and all improvements that necessitated this Declaration have been removed and no encroachment(s) remain. Should this Declaration of Restrictions be so modified, released, or terminated, the City shall forthwith execute a written instrument effectuating and acknowledging such modification, release or termination, which shall be recorded by and at Property Owners' expense.
