PALLOT PARK IN AN AMOUNT OF IMPROVEMENTS OF A MINIMUM OF TWO MILLION, FIVE HUNDRED THOUSAND DOLLARS ($2,500,000.00) FROM DEVELOPER, THE MILTON FAMILY, BY AND THROUGH THE NILDA MILTON REVOCABLE TRUST, FURTHERMORE SUBJECT TO THE PASSAGE OF A RESOLUTION AT A FUTURE DATE, BY A FOUR -FIFTHS (4/5TH) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-85 OF THE CODE OF THE CITY OF MIAMI, FLORIDA AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING TO CONSTRUCT A SEAWALL AT PALLOT PARK, LESS ANY WALKWAY OR FILL NEEDED FOR SAID PROJECT AT A COST NOT TO EXCEED SIX HUNDRED THOUSAND DOLLARS ($600,000) AS PART OF THE PUBLIC BENEFIT PROGRAM FOR E. PALLOT PARK. WHEREAS, pursuant to Resolution No. R-14-0421, the Miami City Commission on October 23, 2014, had a discussion item regarding The Milton Family proposal to make improvements to City of Miami public park, Pallot Park, located at 3805 NE 6th Avenue, Miami, FL; and WHEREAS, clarification on the specific instructions authorized in said resolution are hereby submitted for consideration by the Miami City Commission; and WHEREAS, the Milton Family, by and through the Nilda Milton Revocable Trust, desires to a make voluntary public benefit improvements in accordance with the Public Benefits Program described in Zoning Ordinance 13114, Section 3.14 to City of Miami Pallot Park located at 3805 NE 6th Avenue, Miami, FL in a minimum amount of Two Million Five Hundred Thousand ($2,500,000.00) cost of said improvements; and WHEREAS, the Milton Family, by and through the Nilda Milton Revocable Trust, will make the improvements to Pallot Park by and through certified and licensed contractor; and WHEREAS, as part of the Two Million Five Hundred Thousand Dollars ($2,500,000.00) Public Benefits Program contribution, an amount not to exceed Six Hundred Thousand Dollars ($600,000), shall be allocated for the installation of a seawall only at Pallot Park, thereby remaining with approximately One Million Nine Hundred Thousand Dollars ($1,900,000.00) for other improvements to be installed at Pallot Park; and WHEREAS, the Milton Family, by and through the Nilda Milton Revocable Trust, will hire a certified and licensed contractor to enter into an agreement with the City of Miami, to perform the installation of the seawall at Pallot Park and said agreement to be approved by the Miami City of Miami Page 1 of 2 File ID: 1190 (Revision:) Printed On: 9/9/2024 File ID: 1190 Enactment Number: City Commission at a future date; and WHEREAS, the City of Miami has applied and been awarded F.I.N.D. Grant money in the amount of One Hundred and Fifty Thousand Dollars ($150,000.00) which shall be used in accordance with the award for the installation of the seawall, inclusive of a kayak launch and baywalk at Park; and WHEREAS, the Milton Family, by and through the Nilda Milton Revocable Trust's, general contractor will be permitted to access Pallot Park, upon demonstration to the City Manager of appropriate insurance and certification for the remaining proposed park improvements; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporate as if fully set forth in this Section. Section 2. The City Manager is hereby instructed to bring an item in the future before the Miami City Commission providing for a construction agreement for only the seawall at Pallot Park in accordance with Section 18 of the City Code in an amount not to exceed Six Hundred Thousand Dollars ($600,000) inclusive of F.I.N.D. allocation funds in an amount not to exceed One Hundred and Fifty Thousand Dollars ($150,000). Section 3. The City Manager is hereby authorized to permit access to Pallot Park for the construction of said remaining improvements upon approval by the City Manager and/or his designee of evidence of appropriate insurance listing the City of Miami as an additional insured. Section. 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.
