WHEREAS, the City of Miami's ("City") municipal boundaries abut North Bay Village ("Village") immediately west of Harbor Island, the westernmost island comprising the Village on the 79th Street Causeway; and WHEREAS, the Village wishes to annex that portion of the 79th Street Causeway right- of-way up to the mean high tide mark on either side thereof, from the Village's current westernmost boundary to Pelican Harbor Drive, located on Pelican Island, west of Harbor Island, which acts as the vehicular ingress/egress for Pelican Harbor Marina, a Miami -Dade County ("County") park; and WHEREAS, pursuant to Article VIII, Section 6(e) of the Florida Constitution, Section 171.071, Florida Statutes, and Chapter 20, Article I of the Code of Miami -Dade County, Florida, as amended, municipal boundary changes require County approval; and WHEREAS, the Village has requested a Resolution of support and no objection by the City for such a change; and WHEREAS, the Village has stated that its request to the City is for the purpose of annexing that portion of the 79th Street Causeway into the Village so that the Village may expend funds for beautification and maintenance of the right-of-way; and WHEREAS, this boundary change will not result in a loss of tax revenue as the property to be annexed is public right-of-way that is not subject to ad valorem taxation; and WHEREAS, the City Commission has no objection and supports this proposed municipal boundary change to be initiated by the Village in the configuration depicted herein subject to the conditions stated herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission declares no objection and supports the municipal boundary change application to the County by the Village proposing that the 79th Street Causeway right-of-way and surrounding submerged land up to the mean high tide mark on either side thereof, from the current westernmost boundary of North Bay Village to Pelican Harbor Drive, Pelican Island, Miami, Florida be annexed out of the City and into the Village as depicted in Exhibit "A", attached and incorporated. Section 3. Said declaration of no objection and support of this municipal boundary change is subject to the following conditions: (1) The City retains all its rights, if any, in any submerged lands adjacent to the portion of the 79th Street Causeway right-of-way to be annexed into the Village; (2) The Village or any other applicable governmental entity aside from the City maintains that portion of the 79th Street Causeway right-of-way to be annexed into the Village; (3) The City will no longer, to the extent it has previously, extend Fire -Rescue, Police, Solid Waste, or any other municipal services to the portion of the 79th Street Causeway right-of- way to be annexed into the Village unless otherwise authorized by law. Section 4. The City Clerk is directed to transmit a copy of this Resolution to Connie Leon-Kraps, Mayor of North Bay Village, the members of the North Bay Village Commission, Carlos Gimenez, Mayor of Miami -Dade County and to the members of the Miami -Dade County Board of County Commissioners. Section 4. This Resolution shall become effective upon its adoption and signature of the Mayor.'
