HomeMy WebLinkAboutAgenda Item Summary FormCity of Miami Legislation Resolution Enactment Number: R-16-0501 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 1106 Final Action Date:10/27/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING ("MOU") AND A COST REIMBURSEMENT AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORMS, WITH THE FEDERAL BUREAU OF INVESTIGATION FOR THE MIAMI POLICE DEPARTMENT'S CONTINUED PARTICIPATION IN PROVIDING A RAPID, PROACTIVE, AND INTELLIGENCE - DRIVEN INVESTIGATIVE RESPONSE TO THE SEXUAL VICTIMIZATION OF CHILDREN AND OTHER CRIMES AGAINST CHILDREN; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY OTHER NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO IMPLEMENT THE ACCEPTANCE AND ADMINISTRATION OF SAID MOU AND COST REIMBURSEMENT AGREEMENT. WHEREAS, the Federal Bureau of Investigation ("FBI") has requested the Miami Police Department ("MPD") to enter into a Memorandum of Understanding ("MOU") to enhance the effectiveness of federal, state and local law enforcement resources through a well -coordinated initiative seeking the most effective investigative and prosecutive avenues by which to convict and incarcerate criminals involved in child exploitation that continue to present the greatest threat to the greater Miami area; and WHEREAS, the purpose of the MOU is to delineate the responsibilities of the Child Exploitation Task Force ("CETF"); and WHEREAS, CETF personnel will formalize relationships between participating agencies for policy guidance, planning, training, public and media relations, and maximization of inter- agency cooperation; and WHEREAS, the execution of the Cost Reimbursement Agreement will allow for the FBI to, subject to the availability of the required funding, reimburse the MPD for overtime payments made to the officers assigned full-time to the CETF; and WHEREAS, no matching funds are required from the City of Miami; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute an MOU and a Cost Reimbursement Agreement, in substantially the attached forms, from the FBI for the MPD's continued participation in providing a rapid, proactive, and intelligence -driven investigative response to the sexual victimization of children and other crimes against children. Section 3. The City Manager is further authorized' to execute any other necessary documents, in a form acceptable to the City Attorney, in order to implement the acceptance and administration of said MOU and Cost Reimbursement Agreement. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity ttor ey 10/1872016 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
