A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED
PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S FINDING THAT COMPETITIVE NEGOTIATION METHODS AND
PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS, PURSUANT
TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES;
AUTHORIZING THE ALLOCATION OF GRANT FUNDS FROM THE DISTRICT
4 SHARE OF THE CITY OF MIAMI'S ("CITY") ANTI -POVERTY INITIATIVE
PROGRAM ACCOUNT NO. 00001.98000.882000.0000.00000, IN A TOTAL
AMOUNT NOT TO EXCEED $5,000.00, TO ARTISTIC AWAKENINGS, INC., A
NOT FOR PROFIT CORPORATION, TO OPERATE THE DOROTHY
QUINTANA SENIOR ARTS PROGRAM; AUTHORIZING THE CITY MANAGER
TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS,
IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE.

WHEREAS, pursuant to Resolution No. 14-0362, adopted September 23, 2014, at a
public hearing, the City Commission approved an allocation of funds in the amount of $1.25
million for the newly created City of Miami ("City") Anti -Poverty Initiative Program; and
WHEREAS, pursuant to Resolution No. 15-0106, adopted March 12, 2015, the City
Commission approved the establishment of accounts for the five (5) City Commission
districts, for the sole purpose of allocating Anti -Poverty Initiative Funds to said districts,
utilizing the proportionate percentage of poverty levels based on the five (5) year poverty
rate determined by the American Community Survey, as adjusted annually; and
WHEREAS, the City Manager is requesting authority to allocate grant funds from the
City of Miami ("City") District 4 share of the Anti -Poverty Initiative Program to Artistic
Awakenings, Inc., a not for profit corporation ("Artistic Awakenings"), in a total amount not to
exceed $5,000.00, to operate the Dorothy Quintana Senior Arts Program ("Program"); and
WHEREAS, the Program will benefit seniors residing in the community located near
and around Wynwood by providing services including but not limited to basic arts and crafts
instruction, community interaction to counter isolated lifestyles, and social and mentally
stimulating activity; and
WHEREAS, participants will be from District 4 and members of the senior
community; and
WHEREAS, the City Manager has made a finding that pursuant to Section 18-85(a)
of the Code of the City of Miami, Florida, as amended ("City Code"), competitive negotiation

methods and procedures are not practicable or advantageous to the City for obtaining said
services, and has recommended to the City Commission that the finding be adopted and
that competitive bidding methods and procedures be waived for the Program; and
WHEREAS, the City Manager is requesting authority from the City Commission to
negotiate and execute, in a form acceptable to the City Attorney, a grant agreement with
Artistic Awakenings for said Services;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public
hearing, the City Manger's finding that competitive negotiation methods and procedures are
not practicable or advantageous to the City, pursuant to Section 18-85(a) of the City Code,
is ratified, approved and confirmed, and the requirements for said procedures are waived.
Section 3. The City Manager is authorized' to allocate grant funds from the District 4
share of the City's Anti -Poverty Initiative Program, in a total amount not to exceed $5,000.00, to
Artistic Awakenings, Inc., for the emergency shelters assisting youth in crisis.
Section 4. The City Manager is authorized' to negotiate and to execute a Grant
Agreement with the Artistic Awakenings, Inc., in a form acceptable to the City Attorney.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor. 2

The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
