HomeMy WebLinkAboutR-16-0488City of Miami Resolution R-16-0488 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 1065 Final Action Date: 10/13/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION URGING THE MIAMI- DADE COUNTY FINANCE DEPARTMENT ("COUNTY FINANCE DEPARTMENT") AND THE MIAMI-DADE PROPERTY APPRAISER ("PROPERTY APPRAISER") TO UPDATE THEIR TAX RECORD SYSTEM TO CORRECTLY REFLECT THE ACTUAL PROPERTY ZONING CATEGORIES FOR PROPERTIES LOCATED IN THE CITY OF MIAMI, FLORIDA AND THE OTHER MUNICIPALITIES IN MIAMI-DADE COUNTY, FLORIDA ("COUNTY"); FURTHER URGING THE COUNTY FINANCE DEPARTMENT AND THE PROPERTY APPRAISER TO ADD A DISCLAIMER TO THE FORMS FOR THE ISSUANCE OF TAX CARDS AND BUSINESS TAX RECEIPTS RECOGNIZING THAT ISSUANCE OF THE SAME IS SUBJECT TO MUNICIPAL ZONING AND PERMITTING REGULATIONS OF THE VARIOUS MUNICIPALITIES WITHIN THE COUNTY. SPONSOR(S): Commissioner Francis Suarez WHEREAS, the Miami City Commission ("City Commission") has received various complaints from property owners and tenants of property located within the City of Miami ("City") stating that discrepancies exist between the zoning category of a particular property put forth by Miami -Dade County, Florida ("County") and the municipal zoning category ascribed to the affected property, indicating that the records concerning zoning categories are not always accurately kept; and WHEREAS, this discrepancy creates uncertainty and financial hardships to persons and corporations who oftentimes rely on this inaccurate information when purchasing property or opening a business within the City; and WHEREAS, since the tax card does not reflect updated municipal information, in some instances, applicants can receive an occupational license, also known as a Business Tax Receipt, from Miami -Dade County Finance Department ("County Finance Department"), for a business operating in the City even when the property's municipal zoning does not permit that type of activity; and WHEREAS, the need for both municipal and County government to have correct zoning categories for all properties in the County would greatly benefit all of the residents and businesses in the greater Miami -Dade area; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Commission urges the County Finance Department and the Property Appraiser to update their tax record system to correctly reflect the actual property zoning categories for all properties in the County, including the City and the other municipalities located therein. Section 3. The City Commission further urges the County Finance Department and Property Appraiser to add a disclaimer to the forms for the issuance of tax cards and Business Tax Receipts recognizing that issuance of the same is subject to municipal zoning and permitting regulations of the various municipalities within the County. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' APPROVED AS TO FORM AND CORRECTNESS: 1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
